Got a big WORRY. About 6 yrs ago I applied for and was granted a tourist visa. I wasn't very honest though with my data. I claimed that didnt have any relatives in the US when in fact my parents and 4 sisters had been there as immigrants. I also said I had a daughter. Now, I'm really really worried. How are these things going to affect my papers when eventually I will be sponsored by an employer? Does the immigration or whoever have access to the application form I filed before for a tourist visa? i hope not, I pray not.

Don't worry, consult an immigration attorney, they will do the rest!

I know someone who had trouble with the law in our home country several years ago, went to US as tourist and now have been living legally in US. Remember that US embassy or immigration officer at port of entry ask you if you have ever been convicted or something like that in the papers, he said NO but how come as I have said he is now living legally in US with SSN. I never heard that he went back to our home country though.

jon, that is a question about how deep US immigration will dig into your data when you arrive. Much of that is under their discretion and is on a case-by case basis. There have been times when they let somebody with incongruent, suspicious, inconsistent data in (very rare). Not to scare you but i've a friend who applied for a job online. He wasn't very smart, and used his REAL NAME on one of the communications with the potential employer. Ok, he got sponsored so he goes to the US on a tourist visa. Immigration officer asks if he's looking for a job when he arrives at the airport. He says no, im just visiting relatives. Officer says, are you sure? Other guy says yes. Immigration officer goes to a back room, comes back with a printout of his job offer. He hands it over and promptly deports the poor guy.

Im not saying this is what happens all the time...but they do dig, and when they do, they dig deep.

The thing that you are forgetting, you need to get a Visa Screen Certificate, and that includes a police clearance from your country and any others that you have resided in.

And it is normally run thru immigration in the US as well. Because one person got by with it, does not mean that everyone will. And they are even more strict now, and especially from the Philippines becuase of all of the forged documents that came thru. etc.

You are going to need to obtain counsel of an immigration attorney.

Maybe there is an option for you after passing NCLEX to go to US again as tourist and just apply for an adjustment of status(not recommended though). I think INS don't have an access to your "lied" application papers because the copy of it is in your home country(US embassy). INS and US embassy are different offices.

The have access to all information, it went to the US Consulate and it does nto just stay there. Any information that you put on an application can be shared with all of the other federal offices.

Sorry, but immigration works very closely with US Embassy offices around the world. Remember that you go for your internview at the US Embassy, and that is the final step in the immigration process. Those offices are married, and joined at the hip, and to think otherwise is only going to cause issues for those that think otherwise.

All I can add to all of this:

Never, ever give false information of any document for schooling and visa issues, as well as any application for licensure in the US, etc. Leaving out an important fact is the same as lying and will be treated as same.

I have a tourist VISA to the USA, a multiple entry for 10 years and I have been to the US before for 2 times and I have not overstayed. I am here in the Phil. right now and have recently passed the NCLEX last time I went to California and took the test there.

Will I still be able to go back to the USA and tell the immigration officer at the point of entry that I plan to go to the USA to accept / find a job offer for employment and that I am planning to go for Adjustment of Status? I will not have lied about my intentions but will they allow it? or is it prohibited? Will they deport me back to the Philippines? If so, does it mean NCLEX passers who have tourist visa should not go to the US and just file at the US embassy in the Philippines for GREEN CARD? Thanks...
