Background Check for Domestic Violence

Published

So I got a job offer and waiting patiently for the background check to go through before I can start the orientation. I am so nervous because I was arrested 8-9 months ago. It was a misunderstanding. My husband and I had an argument (stress from having a new baby and being new parents) and I was being stupid calling 911 to get his attention. It turned out they arrested me for being loud or accused of hitting my husband with an empty bottle of water. The female office said she will have to take someone which it was me. Fine! I spent a day in county jail. Instead of my husband pressing charge, the state did. They tried their hardest to lured my husband into testitying against me. Which he did not fall under that trap and stood his ground. He insisted there was no physical alternation. The case was then dismissed. Now, my question is. Since it was dismissed, would this affect me or showed on my background check? The job I am being offered is at a longer term health care facility.

I was arrested for Felony Child Abuse and 2 counts of Battery regarding smacking my daughter (17.5 yo) upside the back of her head. My brother, who was there at the time, told police I kneed her in the head - which my daughter said didn't happen...that was the 2nd count of battery.

Long story short, I refused PTI because regardless of what they say, it goes down as a conviction for BON purposes. The DA, like in your case, did EVERYTHING to convince my family members to push the the PTI. Ultimately, the DA said that daughter's story kept changing and they dropped the case.

I didn't have to explain the arrest to FLBON, but I did have to explain it to the SCBON. NO employer has asked about it. I have worked in LTC and now on Med/Surg floor.

I don't think you have to worry about it. Good Luck.

Hopefully someone will correct me if I'm wrong, however I believe that if the case was eventually dismissed it will more than likely NOT show up on the employment back-round check BUT it WILL show up to the BON when you go to renew your nursing license.

What is PTI? Thanks for words of encouragement. I just felt little nervous since I have never been arrested previously for anything except this one time.

That is a good question. I hope someone can help us answers that.

PTI is Pre-Trial Intervention. What they *tell* you is that they will put you on 'supervision' (aka: probation) for a period of time, you have to submit to conditions like counseling, AA if alcohol was on-board the day of the incident....etc. If you complete the the 'supervision', the charges are "dropped". So it appears that you have no conviction.....but, in reality, if you are put on probation or pay a fine, the government and BONs see it as a conviction anyway.

As far as I understand it, the BON's ask for a complete criminal history which will include arrests. Most employers as for a criminal history of convictions, so arrests don't appear.

My license was expired soon after the arrest but I was able to renewed right away without any problem. I thought the BON was going to ask questions or place any restriction on me and/or the process would take longer. It wasn't! I received my renewal license a week after submitted my application. School I am attending also does background check and I got a copy of the report. On there nothing came up as convicted. It only shows the name of county I was jailed w/o description to why in so whatever.

Hi. I received a citation for physical assault against my husband more than a year ago. He was very verbally abusive to me and refused to let me see our baby who was only 2 weeks old. I slapped him on the face during his abusive comments and called the domestic abuse hotline who in turn called police. Since I was the one who hit him, I ended up getting the ticket. The case was dismissed and my marriage ended up in divorce. Now, I am getting worried about renewing my license. Did you have to hire an attorney? Did you have to tell the BON everything even if case was dismissed?

So what was the final result. Did it show up on the background check at your job.

No, it did not. Thanks God! I got the job without any issue at all.

I'm in the same situation and freaking out, how long did it take for the results to come back? My case was also dismissed but still really worried.
