Application denied by California BRN

I am looking for some advice/hope. I received a letter yesterday that my application was denied by the BRN. I am completely devastated and feeling extremely defeated. I have 2 dismissed charges for petty theft on my record that don't even show up on a background check. I am not proud of these mistakes but I learned a lot from them and did a significant amount of what the board would consider rehabilitation. I sent in more than everything listed on their site to prove my rehabilitation along with certified court records, work reviews, letters of recommendation etc. I have no clue what to do next. I was in contact with a lawyer who informed me that he believes it would be easy for him to fight to get me a clear license with no probation because the charges were dismissed, but that it would take 6-10 months. Which means I would miss my opportunity to participate in a new grad program since it will be over a year after I graduated to receive my license. I have been non stop crying since I received this letter and I have no idea what to do next. They give you the option to take your exam without being able to find out your results and then either appeal or wait an entire year to re apply. Does anyone have experience dealing with this? What did you do? Any help or suggestions would be greatly appreciated. I have no idea who to talk to about this. Thank you in advanced.

I need to go to a hearing, any way you can pm lawyer info?

how long did you wait for enforcement to review your application?

I want to share my story with the CA BRN. I was denied my license mid November 2015. I have two dismissed DUI convictions from when I was a kid - before 21 - over 13 years ago. I was an honors student in both my bachelors and masters programs. I disclosed everything to the board when I applied, including an addiction evaluation done by someone at OHS for $200. I wound up hiring a really good attorney after my denial. Since both of my convictions were dismissed, I was able to argue they unlawfully denied me since AB 2396 was implemented. This states that any licensing agency under consumer affairs cannot deny a license based solely on a prior conviction, if it's been dismissed or expunged. After we sent the appeal, I received an insane stipulated agreement. I set up to fight this. We had an administrative court date set and also brought another lawsuit against the board. At this point I had an addiction evaluation done by an MD specialist (this ran around 4K), as well as several professors, and nursing school friends lined up as character witnesses. A few weeks before the hearing, the board dropped the case and issued me an unrestricted license with a public letter of reprimand. This letter states they denied me, why they denied me, why they issued me an unrestricted license, w/a blip stating what I did wrong in the past etc. It's a slap on the wrist. After three years, this letter comes off my license and it can never be found again. I feel very lucky this all worked out, however the lawyer was very expensive and it was an emotionally draining process. To be completely frank, if I would have realized I would go through all of this, I would have picked another profession as saved the few years this process shaved off of my life. However, I do love nursing and am very happy it all worked out. If you have any questions, feel free to ask me.

I don't know how to help but have you tried calling the BRN? Going to the BRN to see if you can talk to someone might help. I flew to the CA BRN in order to get someone to look at my application faster. Because I pleaded them to see if I can talk to someone in enforcement, I was able to get immediate attention regarding my application. Mine was one misdemeanor 10 years ago that was expunged. I didn't have an attorney but I think I had good luck because I went there physically.

Hi CaliCaliNurse,

I'm in the same situation. I'd like to ask how long ago did these happen and if the 2 convictions were years apart and your age when it happened? I'm scared that once I'm done with school I'm going to get denied as well and be stuck with a huge student loan 😞

Do any of you have any updates?! Just received my letter of denial last week.

Can you share your strong letter? If possible [email protected] thanks for giving us all hope
