Application denied by California BRN

I am looking for some advice/hope. I received a letter yesterday that my application was denied by the BRN. I am completely devastated and feeling extremely defeated. I have 2 dismissed charges for petty theft on my record that don't even show up on a background check. I am not proud of these mistakes but I learned a lot from them and did a significant amount of what the board would consider rehabilitation. I sent in more than everything listed on their site to prove my rehabilitation along with certified court records, work reviews, letters of recommendation etc. I have no clue what to do next. I was in contact with a lawyer who informed me that he believes it would be easy for him to fight to get me a clear license with no probation because the charges were dismissed, but that it would take 6-10 months. Which means I would miss my opportunity to participate in a new grad program since it will be over a year after I graduated to receive my license. I have been non stop crying since I received this letter and I have no idea what to do next. They give you the option to take your exam without being able to find out your results and then either appeal or wait an entire year to re apply. Does anyone have experience dealing with this? What did you do? Any help or suggestions would be greatly appreciated. I have no idea who to talk to about this. Thank you in advanced.

Anyone else out there with DUIs that have had this sort of benefit from AB Bonta (2396)? Please share your story if you have...

I too applied in May 2014 and was denied based on dismissed charges. I had my lawyer submit the information on AB2396 and was still only offered a probationary license. I signed the paperwork April 16 and sent it back and still no license. They said it can take anywhere from 30-90 days for the board to vote and send back their final decision. In the mean time I interviewed for a position and showed them probationary terms and they said they could still hire me. I'm supposed to start very soon but I obviously cannot without a license.

Really wishing I had just applied in another state.

I'm just wondering in what type of facility did someone extend an offer for work? Is this a skilled nursing facility? Hospital???

I currently work at a hospital as a patient care tech, and I interviewed there. So I got lucky. But I'm not sure what level of supervision is required and that could be my down fall because I have heard it's not as simple as I hoped it would be.

I'm sorry you have not yet heard anything about your license. Why do you think (if you have any idea) why you were only offered a probationary license in light of AB Bonta 2396?

i also have 2 expunged charges for petty theft in CA when i was at the age of 18 in 2007? i graduated nursing school with a BSN when i was 24 in 2013. i wrote a letter of explanation and had character letters from classmates and friends. months later, i received my approval from the BON in 2014 to take my nclex RN. I was already expecting the worse but somehow i was granted permission! i'm sorry it did not turn out the same for you... hope everything will turn out okay. i feel your stress and pain.

My current application for my initial RN examination has expired with the California Board of Registered Nursing. I'm wondering do I have to restart the entire process over again or do I just submit a new application and $150 application fee. If anyone can provide any infromation on this process for me that would be very helpful and greatly appreciated.

Hi Everyone, it's been a while since this thread was posted but i was wondering if anyone can share with me what happened to them after their appeal process. I am in the middle of mine. I just got the statement of issues and am working with an attorney.

This is really making me reconsider going into nursing. I have one misdemeanor conviction and arrest back in March 2008. Got it expunged 2012/2013. It was in prostitution. I can't find anyone with my situation. Everyone seems to be dui's, petty thefts, and assaults. Mines is literally none of those. I wasn't on a corner. I was an escort. Got a call and went to an upscale hotel. Got busted. No harm to anyone. Two consenting adults. I don't know how that is relevant to caring of patients and how they would look at this other than the normal judgments that a conviction in prostitution comes brings from society.

I have emailed some attorney's that specialize in CA licenses and hoping to get some answers. This is very discouraging.

@leslieca the statement of issues is from the AG? Also how did you find an attorney? Are they charging a lot? I am in the process of writing my appeal letter and what to be prepared for what comes after.

@achieveanything, I just googled attorneys, called a few for quotes/their idea of what they can do for me, and just made a decision. Its around $3000 now. He had invaluable advice for what to include/what not to include in my appeal letter and how to get support letters and what they should say and all that. Another $1000 if we end up doing into the hearing. Right now I just got the statement of issues back from the Attorney General Deputy, with a bunch of paperwork that luckily the attorney takes care of. From here the attorney is preparing a counter-offer to make an agreement with the AG. Should take another month or so until we send that over and hear something back, whether or not they accept it, or deny it. I am pushing for a Letter of Public Reprimand, which means no probation, no stipulations. If they dont accept that, We can accept something else, probably probation with some stipulations removed.
