For Nurse and Physical Therapists, all countries's cut-off date is 01-Oct-2005

This is all very confusing, Im getting conflicting messages. My I-140 was approved in June 2006, visa fee paid, NVC awaiting biographic data. Does this mean I will or wont be affected by retrogression?

We don't exactly know what are the different countries involved except that PIC and Mexico are affected. So if Australia is affected then by all means you are affected. Try to get in touch with the US embassy in country. Remember this is only for Schedule A workers only. Your Notice of Approval is not your PD, it is your notice of action which is your PD.

I agree with you. Once the visas from the Schedule A are used up, they will remove that category, from what I understand reading the Bulletin, and we all nurses will go back to the EB3 category. For those countries whose EB3 category are not backlog then it is good news for nurses there.

hopefully for all it will be sorted and everyone can move forward. I do feel for the ones who are from countries affected. In a selfish way I am glad I am from one of the countries which shouldn't be affected much but I really do hope things move for eveyone

To clear up any unanswered questions:

Those of you that already have interviews scheduled are safe, you have had a number assigned to you from that 50,000. Those of you that do not have an interview scheduled are not safe, especially in the four mentioned countries.

All petitions will be delayed but then will open up again for those not included. Australia is not included............

A visa number is not assigned until the end of the process, not when the I-140 gets approved. That is only the initial step.

I am an adjustee. Is there anyway, my I-485 will be approved as well even if Schedule A is not current anymore?

My priority date is before the cut off date,does my dependents or derivative have the same priority date as mine? I already got my visa but my dependents are still waiting for their visa.It is is more than 3 mos now from the date of our interview,no additional documents was asked.Why is it taking long to process my dependents visa?:( Please reply I value your opinion on this.Thank you

I think when you passed your I-140 then with the names of your dependents included there then I think you don't have to worry. This is just my opinion.

Or if they were with you during the interview then there is just a delay in the processing. Just call their hotline and ask them why.

Had happened to a freind of mine, she received her visa first and her dependents a month later.

It is 1 month and 3 weeks since my visa was release from the embassy and they still have not release my dependents visa.I called up yesterday and they are still processing .No additinal requirement was asked.It is just difficult to explain to your child why he cant just get on a plane to be united with me.Thank Rep

You should be okay, as long as the petitions were submitted before they stop accepting them.

As long as they were listed, then visas are reserved for them. But I suggest that you follow up with your atorney and find out what is going on, if anything else is needed. You should be doing that, and not waiting to be contacted.
