Hi there,

I am totally lost. I already have a case number MNL2006xxx. I recently received this letter.

"As soon as an interview date has been scheduled, the designated representative of this case (attorney) will be notified. The US Embassy or Consulate General may require additional documentation at the time of the interview."

Will I be affected by the retrogression and how long will it take to process everything?

This is the packet 3 right? and Im just awaiting Packet 4?

Your inputs will be highly appreciated.

Packet 3 is the DS forms you complete for yourself and family who are going with you? Have you completed these forms?

If you do not already have an interview scheduled, then you are affected by the .

Nothing will be done until it is lifted..............probably not before next summer.

If you had a date scheduled, and therefore had a visa reserved for you, it would have stated such in the letter.

Hi anybody know if a green card application from saudi arabia would be affected? I can't find any info. I have a friend who started her green card while she was living in the USA was awaiting her work authorization and decided to go back to saudi arabia for a vacation. Due to a screw up with her childrens visas she could not get back but now she is being told she has to start the greencard process all over again. Can she come back to the USA?She is an RN BSN. My friend is a saudi/korean citizen.

Suzanne,

Finally,I received my dependents visa, after 3 mos and 1 week of agonizing days of waiting.Thank you very much for answering my questions,I always read your messages because I know that your information are reliable.I tell my friends to log on this site because it will give them factual information, experiece by real nurses with one goal of supporting one onother.I paid my dependent visa at the embassy, their names where not included in my packet 4,I submitted their ds230 only also during the embassy interview. Again thank you, thank you, thank you,US is great it really support the principle of uniting families. :wink2: :wink2: :wink2: :wink2: :wink2: :wink2: :wink2:

If your friend left during the process, she will need to start the process all over again. She was going thru the Adjustment of Status process, and that got cancelled when she left.

She will be able to come back to the US when she has a visa that let her do so. And she will need to start the process from overseas, as a retrogression will be starting soon and all will be affected by it initially.

yes, you are affected. unless you have acompleted file and have an interview already scheduled, you will be waiting until the next round of visas are authorized. getting approval of the i-140 is just the beginning of the process.

all can get done while waiting, except that no interview date will be granted until there are more visas made available.

your friend probably failed to put in an application for an advanced parole. it does not come automatically with a ead but needs to be applied for separately - and the reasons for travel stated on the application. you can have an ap with multiple entries but your lawyer needs to apply for it.

To all nurses,

Don't lose hope. This new development is not common. A few of us who are members in this forum were also affected way back in late 2004 and early 2005.

For those whose PDs are after the cut off dates does not mean that your papers will not be process. You will still receive your Notice of Approval, you will still receive your visa fee bill, you will still pay your visa fees and then you will receive your DS-230 forms which you are going to fill up and send to NVC together with other important documents. Once there, you files will lie dormant or should I say, inactive until such time your PD will be current again then you will receive your Packet 4.

As of the meantime, we can not expect something that happened like in May 2005 where Pres. Bush signed a bill that include the "recapture" of 50,000 visas solely for Schedule A. Sadly, there is no solution yet for this retrogression.

This coming November is election time and this retrogression is farthest away from the minds of the politicians here. They won't act on it because it is not an issue as of the meantime. If there is any action, in my opinion, it will be done by at most by the middle of next year.

Let us hope that some groups will lobby both the house of congress regarding this. Way back in 2005, the American Hospital Association had lobbied for additonal visas to lift the backlog.

In the meantime, just do your job in preparing all the necessary requirements so when the retrogression is lifted all you have to do is wait for your packet 4.

Good luck.

Hi Rep! Thanks for making it sound hopeful. But honestly, I really need more enlightening from you regarding all these retro "blues" if you may allow me to call it that way. Oh still trying to be funny amidst all these. Anyway, on a serious note, I AM CONFUSED about my status. I have passed everything CGFNS, IELTS and NCLEX. I have an employer already. I got selected last Nov 2005 and as far as getting the petition approval, my agency says it was approved first quarter of 2006. NVC has reviewed all my papers Aug 22, 2006with remarks saying requirements complete. Most of my batchmates, those that were selected along with me last year got their interview dates, some are done and has departure dates in fact. I think as far as that selected batch is concerned there is 3 of us waiting for embassy interview dates. So where does that leave me? Would that mean I am affected by retrogression? All these stuff is making me confused I am losing interest because I feel my life is put on a standstill. Hope you can enlighten me with your sound and realistic advises. TY in advance.

and if they left the country without it, then they can't apply for it now, as the aos is no longer valid. the process needs to be started all over again.

If you do not have an interview date already assigned to you, then chances are that there is not a visa for you from this group. You should have been given a date already, but Manila is behind in processing.....and it is suspected that the visa numbers that were available have already been allocated to those in front of you.

You will have to wait and see if you get a letter in the next few days or not.
