Need to wait untill your PD becomes current. Since Above PD is not current for EB#3 October for any country, seems no possibility for October visa allocation to you. Stay tuned for November bulletin, if at all something!

I doubt it. It will probably stay at NVC until visas current for PD.

Let me clear up a few things here, seems to be some confusion on this.

The new fiscal year starts October 1 for the US government, that is when the new batch of visas are created, however because USCIS was forced to accept the I-485 petitions last month when there were no visas available, and thus there are no visas available. The October Visa Bulletin that came out in mid-September goes into effect on October 1 and is valid for that month only.

When the November Bulletin comes out in two weeks or so, it will have the information for November and will be valid during that month only.

Since the PD date is bwck about five years for most, do not expect things to be current anytime soon, just is not going to happen, and USCIS is going to be very, very careful before making any changes to that.

For those that have had their visa bill paid, the DS-230 needs to be submitted and approved before the file is sent on to the US Embassy. Since there are no visas available, there is no approval going on with the DS-230. We are not seeing any actually asked for unless they were submitted last year before the retrogression began and USCIS is just asking for an updated version since all expired on July 2007. If they do not ask for it, then they will not accept it, they only accept it if it has the bar code on it, never without.

Just a month before, I have paid visa fee to NVC and choice of agent form given. Re DS230, according to my employer, that was given very b4. I have received a mail from my employer saying my file has been forwarded a lot at NVC and hopefully it will forward to embassy in Oct. Now, Is their any chance that I will be included in this Oct visa allocation..? Any predictions pls..........

Also, I have down loaded a set of DS 230 form in case if they ask it again, to have it ready. Will they accept email/fax copy of DS 230 incase if they ask me to re submit DS 230 again.....?

My PD is Oct 2006.

Sorry, but your employer is giving you very false information. The DS-230 is never accepted before the visa bill is paid, that must be done before the DS-230 is even sent out in the first place. You must have approval on that before your file gets sent to the US Embassy, and you are far from that. With the retrogression still in place, you have a long wait in front of you. Suggest that you contact the attorney that is handling your petition since the employer has no idea as to how things are being done.

And with the retrogression in place, when did you actually get approval on the I-140? How long ago? That is the only step that is not under the retrogression, everything afterwards is stuck in its track.

There are already many ahead of you that are just waiting for their interview and they have had completed files since last year, including the DS-230 that needs approval.

Do not plan on interview this year, it just is not going to happen.

That is exactly my point, that is when the retrogression started, and if approved then, the bill had to have been sent out and paid before they would have sent out the DS-230 with the barcode on it. It never happens just right away, especially then when there was the retrogression in place. That is a fact, so it was never filed back then, that is for sure. Add in to it that you just had the visa bill paid last month, there is no way that anything was done with the DS-230 as it was never sent out previously. Again, your agency is giving you false information that they have no idea about.

The I-140 is not under retrogression, but everything else has been. And if the bill was just paid, then you are behind the retrogression, that is more than definite. You still need approval of the DS-230 once they accept it with the barcode on it. And the fact again that many that have had approval on everything are still waiting, you will be as well for sometime.

But I can add if your agency is giving you false information like this now, what are they going to be like later on? They have no idea as to how things are done in the US, only what they think should be done. If you look at the Visa Bulletin for Ovctober, you will see that the US government is working on PD dates from 2001/2002. There is no way at all that your file is going to the US Embassy for next month.

bulletin indicates processing 2002/3 so nothing happening at the moment, medicals valid for 12 months

no new visas in the october bulletin and this is the beginning of the new fiscal year for immigration purposes. so outlook is not good at this time, there are still many more applicants than there are visas available. and especially from your country, there are many that are in the us already under the h1-b in the high tech industry, so their pd dates are much before yours, and there are less than 10,000 green cards under the eb-3 per year for those from your country.

do not expect anything now until next year at the earliest, expect the retrogression to continue on for at least two years at my earliest guess for those from the pic countries unless something special suddenly appears, but i seriously do not expect anything. perhaps a few visas will trickle in, but not more than that.

I have a friend who was called by the American Embassy in Nepal the end of July and told that they had her documents and to come to the embassy after the first of October. Her priority date is August 1, 2005. When she went to the embassy yesterday, she was told by an employee there who looked at the computer not her documents (and didn't even seem to know about the documents) that she had to wait at least another three years. There seems to be something wrong with this picture. I also know for a fact that only 3 nurses from Nepal have ever gone on the EB2/3 visa from Nepal at least in the last 3 years. Does anyone have an idea about what is going on? What should she do next?

Not sure how it works in Nepal but most have to wait for a letter giving an appointment for interview. Also if you check out the bulletin they are only processing Aug 2002 so no visas for people at the moment with a later PD
