Advance Parole......Lets Talk About It

After so many months of anxiously waiting, there seems to be light at the end of the tunnel (may be July 2005) for end of retrogression. I want you guys for some valuable comments/informations regarding advance parole. Is this for real? I heard alot of stories specially from PIC citizens, that were not able to go back to USA after they avail of themselves with advance parole permit and went home for short vacations. Thanks. i travelled recently with advance parole. AP once issued by USCIS allows you to travel in and out of US as your visa. that is the purpose of the AP. before i went out of the country, i heard a lot of negative comments about AP like it is not a guarantee that immigration would let you in at the port of entry etc. i inquired from my lawyer and she assured me that there would be no problem because that was the purpose we applied for the AP. i called the USCIS customer service hotline and i was told that AP would allow one to travel in and out of the country. so, when i went home to my country last march 30, 2005, i had a peaceful mind. i returned to US through LAX april 30, 2005 and there was no much question asked. just bring with you the 2 copies of original AP issued to you by USCIS.

hope you will have peace of mind too.

Thank you! I will be working in a nursing home. I have not work as a nurse for nearly 12 years. A nursing home is the best place for me to start with. After finishing my contract then I would go back to a hospital setting. :)

Great info! I just found out that my I-131 was approved and it would be mailed to me in 30 days. I am planning to use it to go back home as soon as I receive it. My question is: when should I schedule to come back? My H-1 will be valid until Jan 17, 2006, although I already received a receipt for my I-485. Would my H-1 expiration date has anything to do with the time I plan to come back?

If you have filed for the AOS, which is Adjustment of Status, your H-1 visa is no longer valid, that is why you were required to get the I-131. You are in the process of having your status adjusted to permanent resident, and the day that you submit the petition, your visa that is in your passport no longer is valid. You will be able to travel with the I-131, but if you did not get that before leaving, you would not be able to get back into the US. That is why we always push for getting that.

To enable someone to leave the US soil while processing his/her Adjustment of Status, one can apply for an Advanced Parole to attend to something very important (which would require that you give a very valid reason) for a short period of time. However, some people are scared to use it because its power is not absolute and is always based on the discretion of the officer. He/She may not allow reentry to the US if he believes that there is a good reason for you not to be accepted back in. And not because you were let in before signifies that you'd be allowed entry again to the US. Each situation is different. That's why it is always best to seek advise from a reputable immigration attorney before you leave.

Let me ask you a question. You said two copies, why? Do they take one when you arrive to the US. How many entries youa re allowed to make on AP?
