I am in nursing school with a criminal record (2 theft misdemeanors-both expunged) and am bracing myself for graduation and applying for licensure. I am in MI and have to report both theft convictions to the BON. What is the experience of those in this type of situation? What can a nurse graduate do if the state denies you a license? Like I said, I am not there yet, but just preparing for worst case scenario. I know the BON denies a decent amount of people with criminal records and I am just wondering what the process is like and options afterward.

Take a deep breath and relax. You're going to do OK. But the wisest thing to do is have a consultation with an employment lawyer. It won't take more than that. I don't know who Mi, interprets "expungement". Not sure there is even a record to access if it's been expunged.

If a record is expunged, for the most part it shouldn't be visible, unless you are applying to government related/FBI sort f Jobs. But if the record can be visible to the BON for whatever reasons, Calling them and speaking with someone about it to get their perspective is best. Also, providing things that show that you have been out of trouble and have been dedicating to positive things.

If the state denied you( to which I HOPE they dont), you can APPEAL it. But I almost feel like they would have "their" reason for denying you IF they did, so to appeal, you;ll have to have strong back up and come back , or atleast prepare yourself strategically. Sometimes it can get unfair. but If you can , involve yourself in community services, volunteer work to shadow your positive character development. That should speak some volume.

It will show on the background check because MI request federal background checks. I would encourage you to retain an attorney for the day you appear before the board. The BON is not your friend. They are charged with ensuring public safety and if they feel you are a threat to the public in any way, your license will be denied. You must have someone advocating for you; your attorney. Seek an attorney who specializes in administrative law and who has experience and been successful in defending their clients.
