I have an old misdemeanor charge from illinois and I am have my background check done through the state? I didn't live in that state ever, I was only visiting and never went and took care of it. There is only and 18 months statute of limitations on those and this was about ten years ago. Should I disclose this to the state or will they even look for misdemeanor tickets? I just can't get the court docs I am needing and only have until May 8th to do so. If there is anyone out there who has been thru this and is willing to be honest enough to give me advice, please do!!!

Tis better to disclose past misdemeanor that are not settled to board when applying for license along with letter outlining how events transpired, actions you've now taken to get misdemeanor charge settled along with letters of character reference.

Report it regardless because the BON will find it. Typically states use a nation background check service so even though you were charged in another state it will show up on the background check. Best of luck to you.

Under most circumstances, when you are arrested, you are booked and fingerprinted. Your fingerprint/personal data, along with data about the crime arrested for, are generally sent to state and federal FBI/DOJ databases. The courthouse adjudicating your case should update the state and federal database with the outcome of the case. But this isn't always true. If you had more time, I would suggest that your query your FBI/DOJ record to see what it states.

To answer your question regarding if you should disclose this information, you will likely need to ask your state board of nursing. Trust me, you are NOT the only person with a criminal background. Attempting to better yourself through an education is a sign that you are rehabilitating and reflects positively on yourself. Good luck.
