Please if anyone can help out with this....

I was going through some personal problems and i found comfort in drugs, meth to be exact. At the time i was not working. I ended up getting mixed up wioth the wrong crowd and was convicted of a felony poss of stolen property,& being under the influence. That was two years ago. Since then i have gone to a inpatient rehab, and have been working my steps and putting my life back to where it was. I had been a lvn for 7 yrs before all this occured with a good record. Now i have dealt with the california board of vn's, and they have decided to revoke my license. I have 3 weeks to file a petition as to why they should not. I am now currently working for over 1 yr at the same facility. My don and administrator are aware of all that is going on and they will support me. Does anyone have any suggestion as to what the petition should say?

You need to hire a lawyer experienced in working before the CA BON. There is no other good alternative with so much at risk.

I appreciate that lawyer's are expensive. But if you look at what's at risk, your license and livelihood, I don't know that you have much choice. Borrow the money, etc, but you need representation.

From what you said, the BON is planning to revoke your license. Which probably means you have to present evidence and legally valid reasons to get them to change their position.

The question then becomes: are you capable of doing that yourself?

I believe you can write your own petition without a lawyer. Put in writing what you have here putting down the steps you have done in your recovery. Put down the dates in which you went to treatment. Give references if need be. Such as your former councelor, ask your NA sponsor if they would be willing to write or be put down as a reference. List if you are currently active in NA how many times you attend whether it is weekly or daily if applicable.

I personally believe the Boards of Nursing to be a joke, for reasons I will not entertain at the moment. My daughter had a drug issue. Drug of choice being Xanax. Bad marriage, etc, etc. No excuses for her or anyone else who abuses legal or illegal drugs. Take an attorney or don't take one. It will not make a difference. The board will do what it wants. Probably has minds made up way in advance. Now, if you reported your drug problem yourself you can travel a different road, but if not boards make it extremely hard. Let's not forget that big fine they will lay on you. Don't expect the board to give you any help in aquiring employment if your license is on probation. My daughter's probation is 5 years and may request early after 3 years release and if granted she has to pay something like $1000. She has 17 months left and she is going to ride it out. She had to attend a treatment program. That was 2x weekly for 20 weeks. Random drug testing, at least once monthly and has had 3 x in one month. Every time she goes it cost $72 that she has to pay. She had to do the 12 step program. Monthly paperwork has to be submitted regularly and on time.

I am sorry for you but if they want your license, they will get your license. It was implied to my daughter that to bring an attorney was sort of admitting guilty and the decision they make is justified. I wish you great luck and success with your endeavor. I think after a sertain time you can request your licenses back if revocation does occur.

Im in the felony evading arrest cat................been a nurse 12 years. scared to death..im getting a lawyer.......in texas, it seem if you have a drug addcition, they treat it as a disease and you get a chance...............gte a lawyer, and good luck
