Well I just found out my fate from my state BON. Let me explain....23 years ago, I was arrested for a misdemeanor, charged as a minor AND the judge told me it was a closed case and would be wiped from my record. Well, I did not disclose it on my license application and it came up on my background check. I in know way was trying to hide anything. It had never came up on any of my checks for clinicals and to be honest I forgot about it. When the judge told me I never had to disclose it--it was a closed/sealed case, that is what I thought. Anyway, they have fined me $500 for "Failure to Disclose". I had to provide court records of the incident which did not exist b/c it had been more than 20 years. I know I have to deal with it and move on but it is SOOOO frustrating!:banghead:

Yes, what I did 23 years ago was so STUPID! But ..... Anyone else experience anything similiar?

No, but was concerned my past might come back to haunt me .... expunged misdemeanor 29 years ago ..... the only problem that came up with the BON and my application was a speeding ticket from a few years ago (apparently, because of the speed I was ticketed for, it was a big deal to them - had to provide proof of disposition, etc...yadda yadda yadda). I'm thinking I might've been spared any undue scrutiny due to my youthful indiscretions having occurred before computerized records......kinda like Fred Flintstone, or something...LOL

be grateful that you only have to pay a fine. in mass if you fail to disclose a conviction, you get a 5 year lock-out. so pay the fine and be on your way. im being held up by a driving on a sus lic. but better a 2 month delay than a 5 year delay

Similar thing happened to me. I had a conviction many years ago that I was told would be removed and I believed it and moved on and sorta forgot about it. So over the years I have never reported it to employers and have never been denied employment or entrance into nursing school which further confirmed in my mind that it was not on my record. It wasn't until after I passed the NCLEX and was waiting for my license, that I discovered it was still there because I got the letter from the BON stating they could not consider licensure because of my background and until I sent in court documents and a statement. I sent it all in and about a week later, I got the license!!! I did not know they would fine you $500. I guess I got lucky on that one. I did explain in my statement to the BON why I did not disclose though, I wonder if that helped. I know $500 is a lot but they are going to grant you a license still, right?? Hope so!!

I have my license! I got it 10 days ago. They gave me 90 days to pay the fine but I went ahead and paid it. I am so relieved to have that behind me. I start my new job Monday. I was really worried that there would be a hold up on my license and my dream job would fall through. This is an excellent example of the power of prayer.

I am about to start my third quater of LPN with one more quater to go. When I was 19 (I am now 31) I was charged with Transactional Card Fraud. I took First Offenders and I was given 5 yrs probation and a fine. I recently went to the local Sheriff's Office and had a background check done, and the only thing on there is (Failure To Appear). What does this mean? Does it mean that the original crime (Transactional Card Fraud) is not on my record for others to find out? I graduate in March 2010 and I am scared out of my mind when it comes to take NCLEX. I know that I must be honest about my past, someone please help.........

Hello, I know it has been almost 2 years since the original post was posted. But I'm having almost the exact same problem - my arrest was 23 years ago as well, in New York (I'm in GA) and no one can locate the records. How did you finally get a disposition? I've been working on this for 2 weeks. Getting the run around from central court in NY. Since I was visiting I'm not sure what court the arrest took place in, just the city - a very LARGE city. I sent a set of prints to NY and am hoping they can yield a case number so I can contact the court... Sigh. I graduated last month. I already have a job, but had to disclose all this to them - thank God they miraculously understood. However, I have had to become a tech for now instead of an RN. However, so discouraged now. Such a dumb thing I did! Any help is appreciated. Sincerely...

Had something very similar happen to me except I wasn't a minor. 2 days after submitting court documents and certified letter of explanation, I got permission to take the NCLEX! The longest part of the process was waiting for another state to dig up 22 year-old documents. Don't be afraid to admit your guilt and talk about how you've changed - prove it if you can with documents, awards, etc. Most of all, disclose on the front end! Don't do what I did and spend weeks suffering! Thank you, Lord!

Hi. I just wanted to let you know that I am going through the same situation you were. I recently passed my LVN state exam last month. I had a petty theft conviction 17 years ago. This was so long ago that I forgot to disclose it in my application. I received a letter from the BON of California and states my application for licensure has been denied due to failure to disclose. I have 60days to appeal. I am thinking about getting an attorney to help me out. I don't know what to do. Did you have an attorney? How long did it take them to give you your nursing license? Please help me. Response is very well appreciated.
