Bad check in Florida

Hello everybody,

I have a serious problem. I've started my first semester at Chamberlain College of Nursing in Jacksonville, Fl. The school did a background check on me pre-admission ( I passed) and after completing the first semester they did a clinical compliance background check. I have a petty theft charge from 1995 and adjudication was withheld I also have a bad check from 2010 that was over 150 bucks so it is a 3rd degree felony, however, adjudication was withheld on that one as well. Now, the school called me in and said I am not cleared to do clinicals. I am a licensed CNA and I got a job at a hospital less than a year ago. My question is does anybody know if you can get cleared for clinicals without having your record sealed or expunged? Apparently, in Florida you cannot have your record sealed if you have more than one arrest/charge on your record. I need help please, I've spent so much money on this school to get news like this.

I would contact a laywer ASAP. Did you inform them of your prior issues when you enrolled? Good luck. You might have a long road ahead of you.

As others have said, consult with an attorney. I am in nursing school and clinical with two theft misdemeanors even though they came up on my background check. The only stipulation I faced was that the convictions needed to be 5 years old before I was able to work in a clinical setting. I am not positive about a felony, though. It probably depends on the state but in MI there is a time limitation depending upon the severity of the offense (minor= 3 yrs, moderate= 5 yrs and severe= 10 years). I wish you the best. What was your outcome ? Did everything get resolved and were you able to continue with Chamberlain or did you have to go to another school ?
