i just wanted to start a thread about adjustment of status(aos) for those nurses who are alreday in the usa on some other non-immigrant visa and going for aos.

1.after applying for aos(i-140 and i-485 is filed together, i believe) how long does it take for the ead to come?i had heard that it is within 90 days but somebody told me that we will not get ead until the i-140 is approved. how true is this? some of my friend got ead within a month of filing.

2. does that approval mean we will get the green card right away? what i have understood is for those who are going through consular processing, after approval, the document is sent to embassy and teh applicant has to wait for the interview date and medical check up..then the visa is issued. but for aos, i think interview is generally not done..then what is next after i-140 approval?

3.do they touch the i-485 application only after approval of i-140? i can see that the processing dates for aos(i-485) are different than processing date for i-140 schedule a nurses..what does taht mean? does this mean taht nurses' papers will also be processed just like other non schedule a category applicants? or ours will be faster?

as long as your h4 is current, you should not have any issues with returing to the us. just make sure that it is current when you are planning to return.

and yes, the medical is needed for the ead before they will do any processing of it. it is a requirement that they have it on hand.:)

had palnned to travel abroad next month but postponed for now because the lawyer advised to wait until the travel document arrives. in vermont center, it is taking 2 months for the document. my h4 visa is valid till the end of june,2007. i think i should not have problem if i returned after 3 weeks. but i think it is better to wait for the travel document. just to be on safe side.

The travel document is the I-131, and could have been filed at the same time that your initial documents were submitted.

My lawyer filed the following applications(I485,I140,I131) last January 5th and I received the receipt numbers 3 weeks after.Today, I received a letter from USCIS for appointment of fingerprinting this March 1.My question is,how soon do they need the Visa Screen?Do they need that before issuing EAD?I'm concern because I filed my application for Visa Screen last November and until now,I do not have the certificate yet.And it seems that they have not received my IELTS test scores which was already sent to them TWICE from IELTS.So can anyone shed a light in this matter?It will be a great help.By the way,my application was filed in Vermont.

i don't think they need your vsc for ead. they will send u a letter(rfe) with 84 days(12weeks) to submit the vsc. in the mean time, u can call cgfns and find out where the result was misplaced. if the results were sent twice by the exam center(and if you took the test in usa)then most probably the results have reached cgfns but misplaced. if the exam center is out of us find out the courier and tracking number and track it. never send documents from abroad via regular mail, always use courier.

They don't need the Visa screen for EAD. But please submit it ASAP or begin applying for VSC as soon as possible because they process application fast...

and you have to make sure that you will have it by the time they request for it..

Especially, you will be fingerprinted soon, which is a sign that you're near the end of the process.

I think I know a person whose process got delay because of failure to turn in Visa screen in a timely manner.
