Holiday Pay

Just received my check which covered Thanksgiving. I work night shift and was paid for one hour of holiday pay on Thanksgiving even though I worked an 8 hour shift and had worked an 8 hour shift the previous night. This is the first employer who has not paid me holiday pay for the entire shift. They could have counted 7 hours from the previous shift that was done after midnight on Thanksgiving, or they could have paid me 8 hours for the full shift starting at 11 pm. My question, is this the norm? As I said, this is the first employer who has shorted me this way. I plan on asking the Labor Board about this. Just wondered what other employers do.

I've worked in hospitals that when you go to work Sunday night at 11pm, some consider it to be working 8 hours on Sunday, and some counted it as Monday. It's probably up to the hospital.

It depends on when the holiday begins at your place of employment. For example, where I work, holidays begin at 11pm the night before and run through 11pm the day of the holdiday.

So if I wanted holiday pay for a Christmas night shift, I'd have to go into work at 11pm the evening before Christmas (12/24) and work the night through until 7am on Christmas morning (12/25).

However, if I go into work at 11pm on Christmas itself (12/25) and work all night until 7am on 12/26, the holiday is already over and I am only entitled to the night shift rate. Even though I'm working 1 hour on Christmas by my wall calendar, by my employment's calendar, it's the "next day" already.

Hope this helps a bit.

Sounds like they made an error...either way they look at it, you worked the holiday and deserve the premium. Make sure to follow up with your payroll department ASAP.

I worked a total of eight hours on the holiday, 7 hours from the previous shift from midnight to 7 am, and one hour from 11 pm to midnight. They only paid me holiday pay for the one hour. I am going to contact the payroll department, but I think I will have to see what the Labor Board has to say about it because this employer is as cheap as they come. They already owe me for half an hour overtime that they refuse to pay.

Got it now, I think I was confused on when you worked :)

Good luck!

I think I know what the answer will be. A colleague got told, "Don't try and quote the law to me" when she inquired about the overtime they owe her. See what we're dealing with? I don't even want to talk to this person.

We don't get holiday pay period. Everything under 40 is straight time.

Time to make that call to the labor board on them. They don't take kindly to employers ripping off their employees and intimidating them in regards to it to boot. Keep us posted as to what happens.

I thought this employer didn't pay holiday pay either until I saw this on my paycheck. The staffing coordinator called me and asked three times during the conversation if I worked on Thanksgiving. Personally, I think I would rather not get it at all than to be teased with one hour when I worked eight on the holiday. Playing with the external employees instead of treating us with respect.
