it seems this landmark case is over the head of most nurses so it needs to be reintroduced in terms you can understand. it is about a large group of hospitals banding together to price fix wages and who also blacklist nurses. it could affect your ability to work the entire state. in affect hospital racketeering. this is not going on in just one state but many. it is a union for the hospitals in states were nurses have absolutley no workers rights. if this doesn't interest you then you deserve to work for a few dollars less and if you are wrongfully terminated don't come on this forum and complain.here is the ruling. i hope you will make your voice heard.

They should be held accountable under nurse practice acts.

our profession is in serious trouble. all ers i have worked for run a skeleton crew. the last regular job i worked, the er manager got a 5 figure bonust every 6 months for managing to run the er with less nurses than it needed, b/c this saved the hospital money. i live in a right to hire, right to fire state. your employer can fire you simply b/c he does not like the way you look that day or for any other reason, and you have no way of fighting it unless it is a civil rights violation.:banghead:

like the way you think, but reality is reality. Managers often just want the bonus and know staff will keep on keeping on until stress level reaches a point no longer tolerated, several will quit to be replaced by cheaper help.

There are many reasons for one to be blacklisted! Not all nurses are meek, and take the s*** that is dealt to them. If one speaks out against an MD who is abusive - either sexually. verbally, or otherwise, AND that MD brings a lot of money to a hospital - Who do you think they are going to blacklist? The MD who brings in the revenue? or the RN who is a paid employee? Sorry, but it isn't gonna be that MD. And, don't for one minute be naive enough to think it can'y happen in this day and age! I'm here to inform you otherwise!

Another reason: Tick off a woman in power! We all know how difficult and vindictive women can be, because we work with them everyday. Unfortunately, all women are not nice, and if you tick off the wrong one, whether intentionally or otherwise, face it, you're scre***, because she ain't likely to forgive and forget - she has power!

And another yet, how about not fitting into the right cliques? If you're not liked by the right people and they want to get rid of you, you're done.

AZ is an At-Will employment state. This means that an employer can get rid of an employee for any or no reason at all.

I've been around the block a few times. I've had more than my share of experiences. There are many other reasons to get blacklisted. It isn't based on anything but politics. It sounds like you've been an unlucky soul to have fit in and haven't experienced life. Nurses typically 'roll over and play dead' doing what is expected of us, but some of us don't fit that mold, some of have more of a DaVinci personality. So, we look for alternative ways to accomplish what we want and need to do. You don't have to be a dangerous nurse to be blacklisted!

i completely agree with you. i have seen horrible things in nursing. nurses that would go out of their way to get another nurse fired, just b/c they didn't like her. then try to go to the state board of nursing to get her license pulled. i also have been around the block a gew times. if you make an enemy out of the wrong nurse your goose is cooked. as an agency nurse it is almost impossible not to do that. the reg. staff think you make too much money, you are expected to work harder without making the staff nurses look lazy! and heaven forbid if you ask for a bathroom break or a 10 minute break on a 12 hour strike.

if you are too smart, then that makes the nurses feel like you are being a hot dog. however, if you are not competent and providing the care that you should, then you suck as a nurse and should not be allowed back. and don't ever think about complaining against a doc. agency or not. the hospital will cut you loose so fast that it will spin your head like linda blair in the exorcist.

you are completely right i just got dnr'd b/c of politics. i am so pi--ed. i have been blacklisted by all the bjc facilities. if you live in missouri you realize how screwed that leaves you. they own at least 75% of the hospitals in missouri. i had a lawsuit against them for almost killing my daughter. so being blacklisted does not mean that you are a bad nurse.

missouri is also a right to hire, right to fire state. so you can be fired for no reason at all. i am also one of the few nurses that will not roll over and play dead. :smiley_ab

Sounds like North Texas (DFW Hospital Association) with its Group One. How come nothing being said about racketeering there? For now, prefer to keep what I think to myself.

Group One is being used as an evil tool instead of a way to protect patients.

They use it to blacklist nurses, techs and healthcare workers in Dallas/Fort Worth!!

I had to sue these buggers to get my record cleared (a case of identity theft gone crazy)!

I've found that you can go from good employee to bad nurse in a millisecond. Especially if a change in management has just recently occurred.

I can quit-thank goodness the blacklist isn't where I work (at least I think, will find out soon). But I will be replaced easily, and thus, the powers that be will get away with whatever actions they want...

I am originally from the St. Louis area. Small town hospitals are the worst and the clickiest, (not sure that's a word, but you get the idea).

I hated being employed by BJC.

You can have a status of 'rehire', but never get re-hired even if you wanted to. I'm not really sure how the reference check works out. But being blacklisted pretty much sucks. But, I would much prefer to be blacklisted than to get treated like a piece of sh**. :D

Good luck in all of your future endeavors! Personally, I'm taking a legal nurse consulting course. I'm all prepared for the exam which I will take in October.

Then, I plan to open my own business. I'm getting the paper together to form an LLC. I'm only waiting to get my credentials, and I'm on my way. :balloons: Best of luck to those of you who have a restless spirit, backbone, are willing to take care of yourself.

Oh, I have worked at several hospitals. I didn't mean that BJC is a small hospital at all. I worked at the one in downtown St.Louis. But small hospitals are much worse.

I know this is a very old post, I'm in the same boat. Tried to do right by my residents, protect my license, spoke up, got canned by the powers that want you mindlessly obedient without question or valid concerns What's your update about this, are you working now?
