Remember in one of my post i told you i gotten fired four times in a roll. and i also told you im getting ready to lose my cna because i did a no no no. do all the facility in your area have the same law or rules? ( for example) do all your facility have to polices saying you must go by the care plan? another ( example) do all facility use gait belts to transferred residents or clients? do they tell you its state law or do they tell you its the facility law?

here another question if you were to go in front of the state board and they were going to pull your license because you didn't follow the rules at your last job, would you tell them (example) let say you got caught not using a gait belt on a client, you're being turn into the state for not using that gait belt. would you tell them that if this is the state law than they better go throw every facility or hospital and start puling their license because not all facilites are following state laws or rules?

In the places I worked you have the State Laws that govern safe practice in all facilities. Facilities make their rules accordingly so that they fall within the safe practice laws of that state. SO they typically go hand in hand at some level.

Now lets look at care plans...those are written typically by a RN, facility managment, the MD (sometimes) and the family. They are a set of INDIVIDUAL patient rules made from a combination of facility and state laws. So if these were not followed there is cause for investigaton and terminiation/certificate revokement PRN.

Where it gets tricky is when care lans are not updated or changed as a patients condition has changed or something acute has occured. My facility did what is called an interim care plan that would take parts of the care plan, change them for a said period, and was reviewed after two weeks typically. If those changes needed to be carried on longer, there was either an extention or the main care plan changed. If a caregiver or CNA did not follow this, they were investigated, written up, and could face termination, and perhaps dependant...face certification revokement.

Now I see things being done not in care plans all the time, but rarely do I see things being upheld so strictly...but once in a while someone gets it as an example to all. When I saw a care plan violation I would have a sit down with the CNA/caregiver and explain why the implementations where there and to follow the care plan for the safety of the patient and their own jobs! Typically that is all I ever had to do and they would comply with no further probelm (I listen and teach very down to earth...so usually folks appreciated my warnings and advice!).

As far as what you can do about the revoke and terminiation I really have no clue! I am sure there must be a hearing of some sort...plan well for that! But again...I am just not certain because I have yet to see anyone loose their license or certificate over a careplan violation...stealing or purposeful abuse yes, not using a gait belt no...

I don't know all the circumstances that you are referring to here, but I would think that having been fired four times in a row indicates something serious here. It would seem as if it goes beyond not following the care plan or not using a gait belt. After four times, there is a pattern showing.

Off topic- I see someone has put up Wisconsin information in regards to this. How did you know the OP is from Wisconsins? Nothing intended here, just asking.

will you know what i also posted that i don't have to do anything wrong to get fired. if you look back at some the other posts you will see that some have been fired for something and for nothing. and two also like at some the post where there has been people being fired by bullies. i have check my state,and the promissor i m watching everyday ok.

I agree, I wondered the same thing. I understand there are people who are railroaded out unfairly, but four times? It could be that you never did anything to get fired for, but what about attitude? Are you easy to work with?

i put this way i came to work everyday. when i go on my break i don't sit in the breakroom,or the smoke house like some places do have and listen to the gossip, or b.s. that goes on. another thing im always asking my resident how are you? ive always give a smile. ive had co workers that didn't like me because i mind my own business,and i had co workers who would stand by me when they know that the other staff are wrong about me. now you tell me that this doesn't happen at your work place. how many do you know that there are people that do come to work,and more to themselves?

I have seen her other posts on this same topic. She posted that she has gone to see an attorney about getting her job or certificate back, and the lawyer said there was nothing they could do to help.
