you can consider this thread as closed since information posted here became obsolete on may 11 2005, once president george w bush signed the apropriations bill in to a law to make additional 50,000 visas available for nurses. this thread was started on dec 11 2004 when the worst news hit rn community that the pd dates have been retrogressed to jan 2002 and nurses will be the hardest hit.

now its official.

pd dates for eb3 cases from india,china, philippines retrogress to jan 2002.

this is worst news for the rn community who wish to migrate to us.

this means that, rns who are already in us will not be able to file i485 (aos) after dec 31 2004 till the priority dates become current. its not clear how long it will take.

those who have managed to file aos will have a huuuuuuuuuge waiting time for their gc apporval.

those who are outside us, will have a loooooooong wait

for someone who is in us and has either cgfns/ncelx (with or without visascreen), the only option is to get an employer to file for i140 and 485 before dec 31 2004. this will make them eligible for ead and legal status in us.

considering the rn shortage, there are chances that they may introduce a new visa category or an exception for nurses. depends on how hard the empoyers lobby the congress.

possibly by april 05 nos may be current again /as 130000 nos of 01,02,03,and 04 are recaptured/by july 05 all nos not used by other EB cateogaries will be transferable to EB 3 //lets hope for the best

USCIS goes by a quarter system. Things will be reevaluated again then, I surmise that by June, things will be back to normal. This is why that I suggest that everyone keep doing what they were doing and get all documents completed. I personally don't think that there will be a three year delay but more like 5 to 6 months. Of course, I don't have a crystal ball, but after watching these things for so long.................just my thoughts on the subject.

As stated above, I expect things to be cleared up by this summer. This is also the opinion of quite a few other people also that work in this area.

But please try to use better punctuation. It will make it clearer for someone to be able to understand what you are writing, especially if they are from another country. Some of us are also getting older.............. :)

Do you have all of your exams completed as well as have your Visa Screen Certificate?

I am an Indian Nurse too.And my situation is also same but a step ahead my papers have reached the consulate after NVC action.

I really hope that the dates bcome current as Suzanne said atleast by June.

This post is really encouraging.After putting in 2 1/2 years of hard work(plus lot of money) I was shattered to hear about the retrogression.

It was as if my life had retrogressed.

Now with good souls in AllNurses.com & of course the sponsors of the bill I am beginning to see a silver lining to this cloud!:)

thanks for your hopeful words. Its been a while and my papers have been proceesed by the NVC last jan 14 2005 they said i have to wait 8 weeks well it might be 2 or three years because of the retrogression. I have recently passed the NCLEX RN exam took in Saipan last Jan. 27. I hope that everything will turn out good for the nurses.

But what I learned from the lawyer is not a happy news. According to them, Even if Govt. decide to 'distribute' the so called un-used visa numbers of the previous years, it may not help much. Because there are LOT of EB3 category folks (The category which nurses also fall into) waiting to grab one of those Visa numbers. To make things worse, by the introduction of PERM next month, there will be so many new folks (Non-nurses but still EB3) added to the queue in a faster speed.(meaning fighting for the same precious visa number).

But the good thing is , things would be pretty easy if the Govt. decide to distribute the unused visa numbers ONLY to EB3 - Schedule A (Meaning RNs and PTs) applicants only. This might depend on the future of Tom Lantos bill.

Lets hope for the best.
