Visa Screen for RN about to be MSN/FNP

I have a some burning questions - ok so I have been educated in America.

I have (2) active licenses in (2) U.S. States, I graduated from RN school (undergrad) in the US and subsequently passed the NCLEX. After working for a year as an RN on OPT I decided to complete my masters in nursing - Will graduate in December. I plan to apply for an H1B and then a green card after that. I want to start to get a head's start on getting the Visa Screen Certificate. I understand that I am eligible for the "streamlined process" which doesn't seem so "streamlined". First off - they are requesting the REGISTRAR to send the transcript - no problem - but they have no idea about all the hours I have completed in school - that comes from a different department! How the heck do they want me to co-ordinate between the two? ANYWAY - my real question are

(1) Do I have to wait until I have finished my graduate program and taken my nurse practitioner boards before I apply for the Visa Screen certificate? Or is it sufficient that I have graduated basic RN school, passed NCLEX and are currently licensed. (I plan to apply for H1B based on my NP status). I plan to start my opt jan 2011 - jan 2012 and i don't want the visa screen to delay me if i plan to apply for the H1B in april.

(2) For the streamlined process what exactly do I have to submit? I've read the packet time and time again and I'm still confused ....it's still rather un-streamlined to me/

(3) Do you recommend I get a lawyer to assist with completion of the Visa Screen Certificate or can I do it on my own. I plan to use lawyers when I apply for the H1b.

Thanks for your help!

What if a foreign BSN grad is already in the US with a valid visa, is the visascreen still required to change status to H1B?

thank you.

Sorry, I don't know how to be any clearer - if you are applying for any employment based visa, you need the VSC. Where you are applying from is irrelevant. Only family-based visa applicants are exempt from VSC requirements.

"Where you are applying from is irrelevant." that makes it clearer :)

Um, i have another question, just came to mind 2secs ago..

What is the process of employment based green card sponsorship.

If an employer sponsors green card, does the process have to go thru H1B first or directly to the green card application?

thanks

Employer can go direct to greencard however depending on place of birth and category you could be looking at over 5 years wait for a greencard

Hi Silverdragon,

I am working as a community health nurse supervisor in Arizona state, and i found in AZ they dont need visascreening just the CES do you think my employer can apply H1B without the visa screening? its been a month i started this job and they really want me to stay and work for them, because of the nurse shortage in this area. Please let me know .

Thanks.

Also can they apply green card directly? as you mentioned above depends on list of countries can you provide the countries list?

Thanks

Your employer can apply for GC directly but depending on category will depend on how long it takes, they can also apply for H1b but if not capped you may have to wait until Oct before you can work with it. Visa screen certificate will be required and if you have CES then shouldn't take too long to be issued
