I have a some burning questions - ok so I have been educated in America.
I have (2) active licenses in (2) U.S. States, I graduated from RN school (undergrad) in the US and subsequently passed the NCLEX. After working for a year as an RN on OPT I decided to complete my masters in nursing - Will graduate in December. I plan to apply for an H1B and then a green card after that. I want to start to get a head's start on getting the Visa Screen Certificate. I understand that I am eligible for the "streamlined process" which doesn't seem so "streamlined". First off - they are requesting the REGISTRAR to send the transcript - no problem - but they have no idea about all the hours I have completed in school - that comes from a different department! How the heck do they want me to co-ordinate between the two? ANYWAY - my real question are
(1) Do I have to wait until I have finished my graduate program and taken my nurse practitioner boards before I apply for the Visa Screen certificate? Or is it sufficient that I have graduated basic RN school, passed NCLEX and are currently licensed. (I plan to apply for H1B based on my NP status). I plan to start my opt jan 2011 - jan 2012 and i don't want the visa screen to delay me if i plan to apply for the H1B in april.
(2) For the streamlined process what exactly do I have to submit? I've read the packet time and time again and I'm still confused ....it's still rather un-streamlined to me/
(3) Do you recommend I get a lawyer to assist with completion of the Visa Screen Certificate or can I do it on my own. I plan to use lawyers when I apply for the H1b.
Thanks for your help!

All that is required for VSC is pass in CGFNS exam or NCLEX so you can apply for it now as well as meet other requirements

And you don't apply for the H1B, an employer does.

So can you apply for H1B(through employer) if you have masters degree? what is the effect of retrogression for nurses with masters degree?
Depends on country of birth and that you meet requirements. However retrogression only affects immigrant visa not H1b and if from a country not affected by retrogression in EB1/2 category then I would say better to go for immigrant visa than H1b

i thought visa screen is not needed for the H1B process???
Usually visa screen is required for any application if you are the main applicant. Doesn't mean it will be asked for but may cause a delay if asked and you don't have it
VSC is required for any type of visa that is employment based, be it immigrant or temporary visa.

What if a foreign BSN grad is already in the US with a valid visa, is the visascreen still required to change status to H1B?
thank you.

I believe only persons applying for a change of status through a family-based petition or other non-employment-based petition are exempt from visascreen requirements.
