How far away from your home does an assignment have to be, to be considered "travel?" I know there is a great need in an area about 60 miles away from me as well as another city that is about 100 miles away. I would love to work at these hospitals but would want all the travel benefits and the housing.(especially the one that is 100 miles away.)

There really is no "50 mile" rule like others tend to believe in... According to the IRS, you just have to be far enough out that it is not "feasible" to get the apporpriate rest between shifts. I personally would consider the 60mile trip a "travel" assignment, and most definitely the 100 mile trip.

it really does say 50 miles? my travel tax advisor tells me that there is no 50 mile rule, you just have to be further than you can come home after shift.

Nothing about the 50 mile rule. Just states that you are traveling away from home if: (1) Your duties require you to be away from the beneral area of your tax home longer than an orderinary days work and (2) You need to sleep or rest to meet the demands of your work while away from home.

A simple search on Google with key words for "50 mile rule for travel reimbursement" will reveal many articles, including IRS links. It has been well accepted that the 50 mile rule pervails when audited.

We are not in the advice business of being a Tax Consultant but it is nice to consult, as we do here, with like professionals. If one is down to the samantics of 50 miles versus 45 miles, a consultation with a CPA or similiar expert is in order.
