travel nursing nightmare

Nurses General Nursing

Published

so I am a travel nurse. have been for a year now with the same company. to make a long story short, I am stuck in hawai'i. yes, I used the words "stuck" and " hawai'i" in the same sentence. last week I found out that someone in the contract department decided to change my availability to days/nights from my stated days/evenings. the local hawai'i office received one contract, i received another different copy. now am being asked to be flexible, my day shifts have been cancelled by the hospital becuase they dont need day nurses, they need night nurses. i cant work for any other local agencies becuase i was advised by my recruiter to "walk through" my hawaii license application instead of applying for a permanent one. this temporary license has a stipulation that i can only work for my agency.

so, i have not worked for 2 weeks, going on 3. the local office is trying to get me booked at other hospitals but since i havent been to their orientation i have to wait. i dont know if i am going to get paid for every shift that is cancelled. i cant go sightseeing and enjoy the city becuase that means spending money i might not have. my landlord wont return my deposit if i leave. and to top it all off, i bought tickets for my mom to come out here and visit all the way from new york. in total i am going to be at a loss of almost $3 grand if i leave. which in turn will be more costly to me becuase of the geographic matter. i want them to remiburse me for all my acquired expenses. but, i am afraid to tell them i want to leave fearing they will say i am not cooperating.

does anybody have any suggestions? legal or otherwise?

Best of luck to you-

In all honesty, and with all due respect, it does sound like you might be cutting off your nose to spite your face.??

I cannot pull swing shifts- become physically ill. But, I can switch to nights for a few weeks if needed.

And have full respect and awe for those who pull night shift/day shift doubles. I would be a blubbering idiot.

Again, good luck. Taking the high road isn't always easy.

While I agree they have no right to play bait and switch. The problem is you are there. If you need money then work the night shift. You can do it, you might even find you like it. If you worked just nights it won't be difficult. Take some Benadryl--sleep all day. And then when you get back home I would sue that company.

You need to insist on seeing their copy of your contract. If you contracted to work days/evenings only, they are bound to honor that contract. If their copy is different from your copy, that may indicate fraud on their part. I would send them a letter stating that if they do not immediately honor their contract with you, you will seek the counsel of an attorney. It is amazing how just the mention of an attorney gets people's attention. I don't feel you should be bullied into accepting work on any terms but the ones you contracted for. Good luck.

Oh, forgot. Do all your correspondence with them in writing. You need to make a paper trail. Insist they put everything in writing as well. He said/she said doesn't fly in court. Having it all on paper is priceless.

thanks, i was wondering about that myself. i have asked to see it but nothing yet. however they have admitted it exists and that they will figure out what, how etc happened. my intentions were to leave from the start but feared i would lose any levereage in court if i didnt cooperate. fraud, huh? it had not considered it that way. i consulted with an RN attorney who advised me the same on keeping a paper trail. thank you so much for your comment. it seems to me like you wouldnt back down either, and you still have a nose ( see comment above)

right now they are scheduling me every day. today is wed and have not worked all week. thye said they would work me on days, so they couldnt really schedule me for 24hrs with nights as well. they have not offered me any other options, wont return my calls and when they do they dont have any answers as to what is plan b. i dont know if i will be paid this week, they did last week. but, honestly i doubt they will keep me here without working whether they pay me or not.

Just make sure you fulfill your obligations to them as stated in your contract. If you do that, and they break the contract by not fulfilling their contractual obligations, you will have a strong case if it comes to a court situation. Hopefully, that won't happen.

You know your financial situation, but I think I might start checking around for something else that I could make money doing in case this drags out.

If you are certain that they broke the contract, and you did everything you should according to the contract, and you decide to give it all up and go home, keep in mind you can still sue for breach of contract.

Hope this all works out for you.

Well, thanks for the heads up. I took a cruise to Hawaii in 2006 and fell in love with all the islands. I was thinking of trying to get a contract somewhere over there, but I am an LPN and there are rare assignments.

Expensive? OMG, yes. I hope they pay you for last week. Keep a paper trail and stay on top of them.

You mentioned that you are paying for your mom to come visit, you may have to use that money to get home.

Good luck and keep us posted.

The best way to get the details of the requirements would be to contact several of the agencies that advertise for travel nurses. Some of them work with many international nurses and would be able to explain all the procedures to you.

You might alos want to post general questions on the International Nursing part of this forum.
