Tourist visa question?

Just reading a post there about adjustment of status and it got me thinking. Would it be possible to come into the usa from the uk and make up my hours, sit nclex and get my visa screen apply for a job to sponser me submit my I-140 all on a 6 month tourist visa? Is it possible to do this in 6 months? What about when you land in the usa with a 6 month staying mind how much do they question you what do you stay? I would be staying with my sister for the 6 months and would have enough money for myself and my husband.

the problem may be that cos in the UK you can get the visa waiver for 90 days they can be a bit funny about giving 6 month visas. Plus it may not be possible to do it all in the 6 months. Plus if refused a visa you have to declare it and I don't know if that may have an effect on your application?

You can get the process started during that time, but be aware that you will not be able to leave the US during the prcessing time, and until you have the EAd in hand and then file a special document so that you can leave and return, called an I-131. The immigration attorney can take care of it for you.

A key thing to remember is that you will be here probably closer to a year before you will be able to return home the way that you want to do things.

Once you are able to apply for the AOS, then the tourist visa no longer exists, and you will be required to remain in the US until you have approval.

I would probably come over on the tourist visa and complete the hours, and then return home while you are getting permission to sit for the NCLEX exam. Since you will have done the majority of your training in the UK, you are going to need to get the school to submit transcripts, etc. before you will be permitted to sit for the exam. Things will not happen as quick as you would like them to.

rsmit02.....are you a british citizen? if yes, the US embassy in britain dont give out tourist visa B1/B2 to british citizens.....or are you a foreign national working in the UK?

The US embassy will give out tourist visa's for 6 months but tend to be to the older generation who have holiday homes in the US

So I think what may be better is,

1) Wait for CES report to come back telling me what hours to make up.

2) Try find scool here to make up hours in.

3) If I cant find school here (it is very very hard to and I only have 1 scool withing 4 hour drive of me).....

Then come to usa on F1 visa to make up hours, I know I need to be a full time student for the F1 visa so I could take other interesting classes along with nursing classes so I am eligible for the I-20 I need for the F1 visa. I have my sister to sponser my board and lodgings, my sister to live with and about £20,000 independant funds to show immigration for supporting me and my husband during this time.

4) Apply for visa screen as finishing making up hours.

5) Sit NCLEX as soon as I finish hours and submitt all transcripts to CGFNS for CES.

6) Find an employer to sponser me,

7) File for AOS and green card via employer.

Can anyone see any potential problems?

Yes you are correct on your route of approach. Depending on how long that the make-up will be, you do not necessarily even need the student visa. If it is 6 weeks or so, you can just come as you would regularly, and then return home to get everything completed. Once you start the AOS procedure, you will not be permitted to leave the country.

And to Jon:

The US will grant a 6 mont visa to a EU resident, it is done all of the time.

It is just that they routinely do not apply for it, since they get automatic 90 day visas without doing anything. You have to have the six month visa to get an AOS filed, you cannot do it with the 90 days, since there is no actual visa issued. They get what is called a "visa waiver."

Quick question about the 6 month visa for an eu resident how hard is it to get, I take it I apply in the UK what reason should you give for the visa? Is there a reason they may not grant the visa?

Also I do not want to have to return to the UK to complete things thats why I figured an F1 visa was better, I will be selling up here before I go so will have nowhere to return to. I dont mind that I cant leave the usa while I am applying for AOS.

If you do not want to return to the US, then go for the F-1 visa, not the tourist visa. You will be much better off with that. You will not be able to get everything done during the time of the 6 months. Remember that no processing will be done on your applications until you have actually completed those missing courses. And then you have a couple month wait until they verify your stuff from the UK, as you will be still considered a foreign grad.

I stil recommend just coming over and completing the classes, and then returning home until you get approval to sit for the exam, then come over and stay. Especially since none of you will be able to work that entire time.

First find out what you will be required to make up. Then go from there. You may have less than you think, or more.

I have applied to cgfns for CES so all my transcripts are with them already I am just awaiting the report. But do you mean that for visa screen they will apply for all my transcripts again?

As for returning to the UK it wont be cheaper as we will have to rent a place to stay plus will have given up our jobs so will be living off the sale of the house wether in UK or USA, but in USA I would be living rent free with my sister. I will wait to see what hours I need perhaps me and my husband can take unpaid leave from our jobs to travel over and make up hours then return home to work a while then sell the house as you say I will wait to see what my CES says. Thanks so much for your help as ever Suzanne your knowledge is invaluable if you could bottle it and sell it on ebay it would be worth a fortune :lol2:

So once I have CES and Visa screen I apply to Vermont for permission to sit NCLEX and them reviewing my stuff as a foreign nurse and issuing me permission to test is what can take the time? Once I pass NCLEX that completes my visa screen right and I then look for an employer to file the I-120 for me?
