Supreme Court's Decision regarding NLE

just want to inform everyone that as of today 5pm. our supreme court has already announced its decision regarding the controversial june 2006 nursing licensure exam.

its decision includes:

1. nullity with statistical treatment done by P.R.C.

they will use the original list of board passers without the used statistical treatment. (those who passed because of the statistical treatment will have a retake on of test 3 & 5 which is 1, 687 examinees), (1, 186 examinees who failed because of the statistical treatment may be given their slot back in the roster)

2. those who belong to the original list of passer without the statistical treatment who will be proven to have attended review and final coaching of the 3 alleged review centers may not be issued licenses or revoked...

Im shock abt the news regarding the thousands of supposed to be new nurses who legaly passed the RN exam but unfortunately was deleted on the list. I wonder why the news focus more on the list of retakers and neglect the issue of those who passed but been deleted because of the said 1.1%( more or less) adjustment. I think if justice and integrity really the issue here they should be given the chance to oath. We hope to find balance in the big issue and hope for a sweet happy ending for everyone.

Unless the exam is rewritten in its entirety, it will have no bearing on what the US or any other foreign country does. And that is what truly matters.

The oath taking has been postponed indefinitely and latest news is that their might be more names added to the list so the list posted at the PRC has been rendered moot.

they really won't shut up until everyone would retake test 3 and 5! this is so frustrating...

If you have friends who will take the NLE for the 1st time in Dec. advice them not to take it anymore. Not worth the trouble. They can just apply directly to sit for the NCLEX by applying to their State BON of choice.

correct me if I'm wrong , so it means the prc would be releasing a two (2) list. the one for the list of retakers and the other one is for the list of those who said to be RE_Instated on the list of passers. sorry for being so naive but really.. I'm confuse abt these two percentage of examinees who said to be IN or OUT of the list. So it means were expecting a list coming from PRC that they are including these list of passers who been deleted due to statistical treatment done. The BIG question is when and would they release the list the soonest. tnx laurence.

What everyone if you is not paying any attention to: If your goal is to work in the US or another country, you need to follow the rules of that country. And for the US, it is an entire retake of that exam, not selective areas. Until that time, they will not accept anyone that took the June exam for the Visa Screen Certificate, and anything else in the US.

Focus on what needs to be done in the future, not what was already done and past and cannot be corrected. If you notice that new things come out almost dauly, and then change the next.

The PRC states that they are no longer there and cannot write the exam for December, but then three days later it is as if nothing ever happened. Many of you think that we do not know what is going on over in the US about it, but we probably see even more...........and that it will just be pushed under the carpet, but hospitals and Boards of Nursing are following every item that comes out and they are staying far away from it.

Sorry, but you are 150% wrong. The issue is not if you have a local license, the issue is that you took the exam, and do not have a license to show from it. CGFNS/ICHP is the one that provides the Visa Screen Certificate and without that, the US Embassy will not be able to grant a visa to work in the US.

If you did not take the exam, then there is no issue. If you took the exam in June, the only way that you will get thru immigration is to retake the exam. You can interpret things anyway that you wish, but without ICHP, you cannot do anything.

Yes, that was the original plan and the Court of Appeals' decision that was published on every newspaper in the Phil. and linked here for reading.

1) 1,687 will re-take it because the orig. computation have them actually failing and they only passed because of the re-computation and this re-computaton wasn't in "order" that's why it was reversed by the CA

2) 1,xxx originally passed before they were relegated to one of the failers, again because of the re-computation and since the CA reversed the re-computation they were "re-instated" to one of the passers.

However, all of the above are still in limbo because everything is on-hold again as the CA's decision is not final and executory until after 15 days that it was served and if we will read the CA's decision carefully it actually left many things hanging and for the proper authorities to handle or add.

The CA actually only reversed the PRC's "re-computation" and left everything from the beginning. A clean slate for the proper authorities to handle how it should be handled in the 1st place. The CA also implied that the PRC practiced "abuse of discretion". A polite way of saying that the PRC made a grave mistake by doing the re-computation.

Everything is back to square one in short and the NBI investigations and recomendations will now come into play plus the diff. arguments of those in favor of no-retake, re-take (partial or total) will also be considered.

The Sec. of the Dept of Labor and Employment (DOLE) is actually trying to have a mediation between all parties involved (w/ the NBI's investigations and recommendations as well) so that there can be a "Solomonic" decision where everyone can agree.

This was suppose to be how it should be done in the 1st place if the PRC didn't release the 1st list of passers and failures prematurely and then rush the oath-taking when there was a TRO that was coming. It was 1st agreed upon that no list will be released until the NBI finishes the proper investigations - that is why it took long than usual to release the results in the 1st place if we 'll go back.

By doing the above, the emotions of the students got involved and that is why we are at the current situation right now.

The CA recognized these and reversed everything and we are literally back to square one. But this time the proper authorities already have the NBI's investigations to aide them for the proper decision. And there is also a very good reason why the PRC is now placed under the DOLE (whose head is a lawyer and former member of the CA).

I hope by now, nursing grads will recognize who was actually playing w/ their emotions and trying to cover something and once in a blue moon it wasn't the politicians. They were just there to get publicity but they also know inside themselves that they were mere spectators and no amount of words coming from their mouth would persuade the proper authorities. They have no power over these. Only the gov't agencies involved. That is why they all kept quite when the CA decision was made public already.
