Supposed Failed Background Check

To begin this is not for a nursing license but rather nursing school. I was recently accepted to nursing school, excited as could be. As a requirement, I had to submit to a drug test and a background check. I passed the drug test but according to a letter I received today, I failed my background check and may lose my position in the class.

So here is my history:

In 2013 while finishing my BS, I was falsely accused of possession of CDS paraphernalia-marijuana. In the beginning of 2014, the charges against me were dropped and the case was disposed with a nolle prossed. This is in the process of being expunged from my record, however showed up on my background check for school. Because the case showed up on my background check, I did not 'pass' my background check.

According to the letter, they will be submitting my background check to the clinical facilities which I will have to work at. If they deem that I am unable to work in their setting, I will lose my spot in the program.

SO MY QUESTION:

Is there any reason why a clinical facility would deny me to participate in their facility for having a record of a nolle prossed?

I have read stories on here of people being given employment even with having a nolle prossed and other nursing programs around specifically state that a nolle prossed cannot disqualify you from their program.

It sucks that we as people are not actually innocent until proven guilty but rather guilty even if proven innocent.

I will hopefully be meeting with my Dean of Nursing on Monday or Tuesday. However, I received this letter today on of all days Friday the 13th. So now I have a long 3 days of waiting nervously to find out if they're going to kick me out because I'm innocent and a victim of a flawed system that doesn't immediately remove non-convictions from your record.

For those of you who ask how I was falsely accused:

I lived in a dorm apartment with 4 guys. We had 2 bedrooms with closets in each. My roommate left a bong in a common area of the closet. University Cops got called for something ridiculous. They asked to search the apartment and as I had nothing to hide, gave them permission to search. Roommate wasn't there and they suck me with possession and didn't bother to pursue my roommate. I agreed to drug test and even tested negative and they still tried to pursue the charges. It was the most ridiculous moment in my life.

It means I am essentially not guilty, without them wasting court time to say so.

From everything I have read, people have gotten jobs in the healthcare field with nolle prossed, and in many programs it specifically says that a nolle prossed will not disqualify a person from their program. My program however has no stating to this besides that you must pass your background check.

This is going to be a horrible weekend of wait. Btw I am in MD.

Any updates? How did you apply for nclex and did MBON ask for any documents from you? I'm in a similar situation.
