Starting 2020 NO MORE LOCUMS IN CALIFORNIA

Assembly Bill 5 has been passed and is soon to be signed by the Governor. It exempted medical doctors but did not exempt nurses, nurse practitioners or physician assistants from the legislation.

The bill prevents US, NPs PAs, and RN from being independent contractors in the State of California. LOCUMS IS DEAD.

You can not work in California UNLESS YOU ARE AN EMPLOYEE. I loved being a 1099 contractor and doing locums. I guess I will be moving out of State to continue my career. Look out....this kinda of crap could be coming for your state too.

I don’t know think that NPs are vulnerable employees but I would argue that a lot of the other gig economy folks are- ala uber drivers.

A big part of their wage depends on tips which not everyone is inclined to do plus tipping has its racist origins that continue today. I much prefer the European style where their workers are given fair wages and tipping is not expected there. Makes every service industry here in America fake and cheesy.

I agree about workers like Uber drivers. However, NPs are paid very well in California and this law should not apply to highly paid professionals like NPs. It exempted MDs, so it should exempt NPs.

So what will happen to me come Jan 1, 2020? I'm not sure if my doctor follows this. Do I have to tell him he has to hire me as a W2 employee? What happens to me if I keep working as 1099?

If you keep working as a 1099 the State can sue your doc for violating state law if he doesn't start deducting payroll taxes and providing you benefits mandated by the State.

No I agree and I think this will ultimately hurt rural patients who depend on locums to provide care. Which is a shame that we will have people suffer while waiting for a fix

Exactky, I think it’s a huge oversight that they exempted most other high paid 1099 professions (MD, attorney, etc) but not NP’s.

Hopefuly they’ll ad exemption for us later, but I would contact CANP board to make sure.

I did contact them. They stated "we are having discussions" regarding the the bill. I think they dropped the ball when this bill was passed. If you look on their facebook page it states they were in favor of this bill with some exceptions. They should of never been in favor of any part of this bill knowing what it would do to us and to our patients.

Yes, I’m also confused why they were in favor. Most of my RN and NP friends work at least partially on 1099’s, clinics and hospitals love the flexibility that comes with those part time shifts, otherwise they wouldn’t be able to get coverage and we wouldn’t be able to get extra income!

And all nurses that I know work 1099 by choice and love it.

Maybe they somehow didn’t realize the impact this will have, I hope they will and will fight for exemption in spring.

This occurred because the legislatures were trying to fix a problem for low-paid laborers but only made the situation worse. They classified highly educated and skilled professionals as "Gig" workers. Hair stylists were "exempted." LOL. It goes to show you how much research was really done before AB5 was written. These supporters of the bill and legislatures are trying to set NPs back 20 years...Please sign the petition to have NPs added to the "exemption list."
