hi,
i would like to ask a few questions from this forum regarding a nurse (the girlfriend) moving from u.k to the u.s. to live with me (the boyfriend).
while discussing with few agencies, she is consistently told that it takes about 18 months and that she needs to stay in the u.k during the entire time. i am quite surprised that after the green card application is filed, she is still not able to stay in the u.s while waiting for the proper documents.
isn't it possible for her to pass her exam in the u.k and come to the u.s and find a sponsor here and be here while they (agency or the hospital) do the work?
before i make any decision i would really like to feel comfortable that i do have all the facts.
therefore, i would like to have your advice/opinion this: is there any way she can come to the u.s sooner than 18 months?
thanks in advance.

immigration into the UK usually involves getting everything together externally until she gets work permit and then can work in the UK. This will change if you are getting married and then she will need either a fiance visa if you get married in the UK or spouse visa if you get married anywhere else. At the present moment it is hard for you to get married in the UK without fiance visa or I believe work permit. You will still be looking at approx 12 months
Starting point is NMS where she has to apply for evaluation once she gets that she then has to do a 20 day accredited course, which once completed will get PIN from NMC which will then enable her to look for work and apply for work permit. here are a few links which may help.

Anna, I think the boyfriend is in the US and the girlfriend is in the UK. Looks like he is asking for info/advice about a UK nurse moving to the US, like us
Thanks Letina and sorry for not being clear. I am asking about a U.K nurse coming to the U.S. I need to know if she can come for longer time (than few days) visits to the U.S while waiting out her 18 months.
Thanks.

First, you can apply for a K-1 visa at any time for her. You need to speak to an immigration attorney. This is completely separate from her being a nurse, has actually nothing to do with it. There are certain requirements that go along with that visa, etc.
As for the nursing, it depends on when she graduated from her program and where, most of the current programs do not meet licensure requirements for the US currently, she would need to make up the required courses before she could apply for licensure. Fastest for you is the fiancee visa, but with that, you will only have 90 days to get married.
oops Thanks for that :imbar guess I should have read it more just with it being stuck in UK :chair:
Back on the right topic. If moving out with intention of marriage K1 and get married within 90 days of arriving in the US or go through greencard like suzanne mentions but will take minimum 12 months if training makes her eligible

Thanks Suzanne4. It is rather frustrating that she is not even able to visit me on her vacation times while waiting for the Green Card.
Thanks every one.

if she takes it steady there is no reason why she couldn't visit the states whilst waiting for her greencard. I know someone who did come out a month before her medical and interview, another one who visited a few times whilst again in the process of green card and I spoke to my recruiter regarding visiting US whilst in the process and was told that wasn't a problem. ould check this with an immigration lawyer if necessary
The biggest problem I see is how long did your girlfriend train because training done in the UK for the past several years does not meet the criteria for working in the US. When did she train?

Thanks Silverdragon102,
She has graduated in 1992. I hope that it was a good year. I am quite intrigued with your comment about her being able to visit me every now and then while waiting for her green card. Do you know any recruiter that allows this?
Thanks again.

Why does it have to be through a recruiter? Can't she just take a vacation to see you? As long as she returns home, what is the problem?
I've never traveled out of the country (I'm in the US) so I am clueless about this.

I travelled to US 3 weeks before my green card interview. My son is living with us in the US his green card interview is next month in the UK, he can visit here for up to 90 days. Does your girlfriend hold a british passport??? 1992 sound good as far as training but we couldnt possible tell you if it is ok or not, her transcripts have to be verified. Dont go with an agency they will get you here quicker but you are very tied and the money is a lot poorer.
Thanks Madwife,
Yes. She has a British passport. With what I read here it seems there should be no problem for her to make visits to the U.S. I believe she needs to go back and get more information about the process.
