There's no claim against my RN license, no violation, no criminal offenses or charges. I'm a competent and a good nurse. Former employers had good evaluation. One of the local contract agency threatened me that i will be on "do not return list" if i did not start the contract. I have some personal matters that needs to be taken care of that's why i'm backing out.
No formal signed written contract yet -all verbal. I started some papers works done on the side of the hospital but that's about it. We do not even have a start date yet (the agency did not even knwo when). Do they have grounds against me? , can they put me on do not return list for this? What are the legal guidelines for this don not return list? Prompt response is highly appreciated. Thanks.

I think you don't have a clear understanding of what blacklisting is.

Black listing is systematic and interferes with your working for everyone.
A DNR lists is kept by a facility with the names of nurses they do not want the agency to send. It's not shared with other agencies or facilities, it doesn't prevent the agency from sending you to another assignment.

Texas labor law states
52.031. BLACKLISTING OFFENSE; PENALTY. (a) In this
section, "blacklist" means to place on a book or list or publish the

intending to prevent the employee from engaging in or securing
employment of any kind with any other person, in either a public or
a private capacity.
(b) A person commits an offense if the person:
(1) blacklists or causes to be blacklisted an
employee; or
DNR list is a list of names of employees that cannot return FOR SOME REASON.
They aren't intending on preventing her from engaging in employment of any kind with any other person. They are listing her so that she is no longer able to return to a specific facility or agency.
If you work at a hospital, then don't show up for work, are they not allowed to not only fire you, but also make sure you are not rehired by the hospital?
If I were a facility using an agency, I would want the option of placing someone on a do not return list. If there is a poor and/or unreliable performer, I think the facility should have the right to tell the agency that person is no longer welcome. If the agency chooses to continue to employ that person and place them elsewhere, fine. The particular facility isn't preventing that, it's simply preventing that person from coming to them alone.

Your license has nothing to do with being put on a do not return list. The do not return list is agency and/or facility speciic. It's no different than being made a "no re-hire"
