Not to get too personal by my girlfriend is going through a pretty ugly custody battle. her ex has called children and youth on her numerous times all with unfounded results post investigation. Now they decided to go after me. My results are unfounded and I am up for renew on October. Does the BON do Child abuse checks. If they do would having an "Unfounded" report effect my renew?
if you have a personal malpractice carrier please contact them ASAP for advice, this is what they are there for and they have a team of lawyers specially trained in license defense which is essentially what you need to do, defend your license against false accusations of child abuse and/or neglect. Contact your county lawyer referral service if needed. Consult your girlfriend's attorney if her ex is making false reports to youth and children's services as an act of retaliation this could be an indictable offense. In other words, get legal advice from a licensed attorney before its too late.
I agree. Attorneys can be expensive, as you know...but things like this that can result in a criminal record and/or BONs investigating your license can be far more costly in the long run because it will affect your livelihood. You need legal assistance stat.
Best of luck.
Per Terms of Service, merged multiple threads. JustBeachyNurse has offered you good advice.
With PA now requiring several professions to have Act 31 of 2014 – Initial Training and Continuing Education in Child Abuse Recognition and Reporting Requirements, there is heightened concern re child abuse at BON.
Please carefully review online renewal form for wording re required reporting ( PA no longer has paper form online due to online renewal only). Since you are concerned about retaliation, I would prepare a statement with lawyer assistance to submit if needed. Contacting malpractice carrier recommended to see if they can assist with this issue. Lawyer Lorrie Brown RN,JD offers good advice re License Protection Services for Healthcare Providers: Are you worried someone might file a complaint?
If you believe that there's a possibility that someone will file a complaint with the Licensing Board, then now's the best time to seek legal counsel. Remember, anyone – a patient, co-worker, supervisor, family member – can file a complaint against you, and once that happens you have a limited time to respond. We help our clients to be proactive, by gathering and preserving the evidence to protect their license and preparing a response in the light most favorable. In fact, many times by hiring an attorney who prepares your response at this early stage, the State may close the matter without filing charges!
American Association of Nurse Attorneys may be of assistance too.
Hoping time will decrease girlfriends ex's angst.
