Received Green Card for Self but Not for family

Hello All,

I am so excited to share the News. Today I recd in mail, the Green Card for myself valid for 10 years. My I-140/I-485 filed concurrently at NSC (for me and family) had a priority date of Apr-3, 2006. My I-140 was approved in Dec-2006, and my I-485/Green Card recd today.

The only thing that bothers me now is that the USCIS on-line status for my spouse has not changed, and my spouse's processing still shows under process/pending. Our papers were filed together. Is this anything of concern? or is it that available Visas have exhausted?

Pls pls respond if anybody has any insights to this situation.

Thank you, of course I will check the visa bulletin. But I still don't understand how someone with a PD in april 2006 and an I 140 approved in dec 2006 could get a green card, not the AOS the GC ...especially india is one of the PIC countries no ?

The green card is the final outcome of both the AOS and the CP processing. Both procedures require the I-140. Then it changes:

For the AOS, the I-140 can be submitted at the same time of the I-485 and the petition for the EAD provided that there are visas available at that time and USCIS is accepting the I-485.

For the CP process: The i-140 must be submitted and then approved, and the visa bill paid before the DS-230 is sent out to be completed. That needs to get approval as well before the interview will be scheduled with US Embassy.

The person that you are asking about used the AOS process for the green card, and got their I-485 submitted before the retrogression started last October; that is why they were able to get the green card now. Most that got their petitions in by the cut-off date of last October 31 for the AOS now have their green cards in hand.

And as I keep mentioning, it is not just the PD date, but when the file is completed as well. Since the AOS petitions were accepted, they were acted upon, and those that got visas this summer from that, got them because of the recapped visas that USCIS was able to use.

You need to have the DS-230 submitted and accepted to be able to be considered for a visa in the first place, that is when the visa number is reserved for you under the CP process, nothing is done with just the I-140 submitted and approved.

With the I-485, in the past, there were visas available when the petition was accepted and a visa number essentially reserved. When the I-485 gets approved, it means that the green card will be following shortly.

Hello Suzanne4 and Loved, just updating that it has been a month (issued Sept-15) since I got my GC (via AOS) and my spouse did not recieve it yet. I am still with an understanding that, if they approved the GC for me then they also wld have blocked for my family too. Is this Not correct?

Several here had their green cards arrive for their spouses and other family members several months later. And you are correct, if they were on your petition, then they have had a number reserved for them.

You may just wish to follow up to make sure that it did not go to a wrong address, we have seen that happen before as well.

Loved, your case was similar to mine, whats the latest at yr end?

I am still holding onto my " belief " that if my GC was approved, then the Visa numbers were also blocked for my family members. With the latest News about FBI checks pending >180 days , I am just hoping that USCIS would process and approve GC for family members.

Any thoughts or insights would greatly help, pls.

Thank you for giving us update. My husband's case is quite complicated. We did get an interview notice and we went (last week). The one interviewed us did not read my husband's file at all. He was not really sure what was going on with my husband's case and he said he needed more time and maybe more info to make a decision. So we are still waiting. Will let you know if there is any news.
