I am starting a new thread to track cases from NVC - embassy to GC.
The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.
Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!
The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

I haven't been posting for a while cause there is nothin to post. My lawyer has simply refused to file my updaed ds230 coz they don't see me receiving my visa in the near future. they don't want to keep on refiling evey year or something. My employer has said lawyers know best....
but just the same, I monitor this thread first thing in the morning and last thing at night, just to be updated. Ayways, good luck you guys....hope to hear more good news from you.

It is better to see the mailed checklist from the NVC, you will see there the actual missing or incomplete documents that they need, my lawyer scanned and emailed me the letter from NVC, and my own eyes saw that passport copy is what they need so my lawyer resubmitted it for the 2nd time around, maybe ask your lawyer a copy of this letter if possible.

hI JAKEY, I have a friend who is in the same dilema as yours. Her lawyer also refused to resubmit her DS230 until visas are available. I am just wondering why some lawyers do that. There is no harm on refiling. The only additonal cost to them is the mailing of the documents. So sorry to hear that your lawyer refused to file again.

were on the same track my lawyer also didn't file my updated DS230 form..May I know your law firm maybe we have the same lawyer? From Phoenix?
to agp ph I also received that kind of notice from NVC lat year..I was documentarily qualified by then but then I was hit by retro and this year they are asking for my updated DS230 unfortunately my Lawyer didn' file it back to NVC???
weird!!? why don't they re-submit your updated ds-230? i don't see any reason why. it won't cost them a thing. you can actually change the choice of agent if your lawyer is just delaying things. you send NVC a letter of something. not sure though..but i'm sure there is something like that.

They cannot file an updated DS-230 until NVC asks for it. And if they have not filed it when it was asked for, sorry but they are then just delaying you. NVC only asks for things if your file is open and they are working with it at this time.
And shame on your employer. Guess that you have two working against you, instead of trying to help you.
attorneys may ask for the updated information to have the ds-230 ready when the nvc asks for it. nvc will not accept it if it does not have the bar code on it, no matter what.
then there are the attorneys that do not do a thing when immigration actually asks for it. if your file was not open, then the new ds-230 would not even be requested. they are currently only requesting them for those that had approval on them before the retrogression kicked in last october.
so thank your attorney for the extra wait that you will have. shame on them. but they know everything..........not.
and shame on the employer for not knowing better. hopefully the attorneys that are doing this type of laziness, or not doing it, will not have their contracts renewed.

I am not sure if NVC actually asked my lawyers for an updated DS230 coz he isn't saying much. But when I emailed NVC regarding the status of my case, NVC emailed twice and asked me for an updated DS230>this I forwarded to my lawyer several times. My employer believes that the lawyer knows best so I can'tdo anything about it. Now i just sit back and watch evryone get their case completed.
I am not yet panicking though as EB3 SEp 2007 VB is still way off my PD date...still keeping my cool and sanity (do i have a choice?)Anyways, thank you Suzanne for your patience and hope all is well with you....
