HELP! regarding criminal background & nclex results

Nurses Criminal

Published

i took nclex pn early september 2014. before taking the exam, i received a letter in the mail about my background history. i did what was asked of me and mailed in police reports and an explanation regarding the matter. *my prosecution was expunged*

it is now two weeks after my test date and i want to know how long anyone in the same or similar position waited for their results since I'm sure ppl with criminal backgrounds are prone to longer waiting periods.

also, i want to know if anyone knows about a person with an expungement or anything on their criminal history that denied them of licensure.

p.s. i live in california

Well...I can tell you that I wad arrested and never charged. Still showed up on my background. It took about 10 days once they got the paperwork. That was in TX though.

They likely want a written statement from you and the charge sheet/arrest record along with a fee for reviewing it.

Specializes in Psych ICU, addictions.

If you failed to disclosed that expunged charge to the BON, that's a deal-breaker right there as far as BONs are concerned.

Otherwise, if you disclosed it as required, all you can do is wait. Unfortunately it does take longer to process applicants with a criminal history because they evaluate each on a case-by-case basis...and sometimes they only do that at monthly meetings. So hang in there.

IMO, if they want to you appear and/or want a statement from you about your record, I strongly urge you get a lawyer involved. The BON is NOT the nurse's friend. They care about the public first and foremost, not about cutting you or anyone else a break. You can find lawyers versed in dealing with BONs here: TAANA Executive Office - Home

Best of luck.

I submitted my application in early April along with everything they asked for about my convictions and rehabilitative efforts. I finally received a denial letter in early August (4 months) stating that I could take the NCLEX but they'd conceal my results until the appeal process is over and a decision is made. I hired an experienced licensing attorney, appealed and waiting now for a response from CA BRN (likely 4-6 mos).

that is such a long time! three of my classmates also with convictions (one was arrested and another with 2 DUIs) did not have extended waiting periods and received their results/licenses pretty much the same time as my other classmates with clean records. i guess the only thing we can do from this point is wait. good luck!!

Your classmate with the 2 DUI's applied for California license? Do you know if they got an unrestricted license? I'd like to know because I am in a similar situation (two very old DUI's). Thanks!
