Hi all nurses! I am new to this forum and I stumbled upon all nurses as i am doing my research in the internet for people of the same case as mine. I am a Philippine RN but currently based and working here in Singapore. I have an immigrant visa petition under EB3 category and my priority date is now current. I have recently received my P4 appointment letter to appear for a consular interview. My problem is that I havent taken my NCLEX exam yet though I have already filed for it last November 2013. I would like to ask if there have been a recent scenario as mine among my Filipino co nurses who appeared for a visa interview and was granted a US visa without your NCLEX yet? I have a valid VSC though. I have been trying to review while working here in Singapore but because of the heavy workload and the long working hours I am dead tired as i reach home and doesnt have time to review at my best. i hope some of you here can shed light to my dilemma so that I could decide on whats best to do. Yes it is still valid.I just spoke to our lawyer in CA and he told me that my petitioner is still willing to sponsor me and send me the job offer. I have even asked him will it not be a problem for me should I appear for the interview without passing the nclex.He said its alright as long as I have a valid VSC and the job offer..so i just follow as what they instruct me to do..

Discuss with the immigration lawyer that you are likely not qualified for a CA RN license without further education due to enforcement of concurrency issues (since it seems you graduated in the Phil after 2008) as this will affect your job offer. Be up front especially if your visa is linked to a specific job/employer. A CO RN license will not permit you to work as a CA RN. If expenses are being paid by the sponsoring employer you may have issues if you are not qualified for the job (based upon present ineligibility for a CA RN license).

Why did you not apply for licensing in CA? The concurrency enforcement most likely affects those who graduated 2008 and later.

Only you can make that decision. I cannot advise you. If your immigration attorney has all the relevant information and still advises you to attend then it would seem prudent to follow your attorney's legal advice.

I would suggest reviewing the CABRN requirements especially if your RLE cases were concurrent with clinical and theory. More recent grads did not have the cases completed until much later or post graduation & thus denied eligibility
