For those foreign RN in the U.S. with H-4,B1,B2 visas who expect to pass NCLEX until September '06 with employers waiting to sponsor are they gonna be affected by the coming retrogression?

Is it still retrogression safe to file for a greencard until October?

Yes, you are going to be affected more than likely. There is a mound of paperwork that needs to be completed by the immigration attoreny, that is why there fee is in the $2000 to $3000 plus range just for doing the paperwork, if not even more. And there is a cruch on to get things completed................

Even if you have an employer lined up, remember that you will need to submit a copy of the Visa Screen Certificate with the I-485.............both the I-140 and the I-485 need to be submitted by the cut-off date or USCIS will not accept the petition. And that will take on average of about four weeks if you trained in the US, and more if trained out of the US. Especially if you are trying to get approval now, and if you are from the Philippines where the retrogression is definitely going to affect you.

Next, will be dependent if the employer has gone thru the proper channels about posting of the job, it has to be posted in their office for at least ten days, and then the petition can be submitted 30 days after that.

Have you actually spoken to an immigration attorney that specializes in RNs about this. And do you get to pick the attorney, or is the facility? Remember that the facility cannot legally make you a job offer without actual proof from the Board of Nursing that you passed, just seeing your name on the website is not proof for Immigration Services.

I know it is not what you want to hear, but that is how things are right now.

There were things that oculd have been done to get things done for you much faster but you were determined to do things yout way and not to listen. I can only make suggestions, and you will find that I know what I am talking about.....................

plenty of threads both on here and the phillipne forum. basically supply of the extra visas are running out. no one knows yet which countries will be effected and for how long but expected to be countries where the demand for us visas are high ie phillipines. just continue with plan and pass nclex, pass english exams etc things may spead up or there again things may be delayed for a few years. as i said no one knows what will happen but delays will happen once the visas run out approx november and after the us elections etc probably the new year before anything is done

The immigration visa is current for the rest of September and the whole October. I was told that it may be still current for the some part of November. I think you should not wait for Visa Screen, they will accept your documents without it and will ask for VS at the later date.

The petition for the I-485 should have the VSC attached, especially if they are not going to accept anything after the cut-off date. That means that all petitions need to be complete at that time................or nothing is going to get done with them. There also needs to be verification from the actual state where the NCLEX was sat for to be submitted.

Just like with the cut-off date for the CGFNS exam, that means that date that everything needs to be received by them, not just one thing with others to follow.

Best bet is to speak with an immigration attorney that specializes in nurses, that is what I do.

The retorgression will afffect all initially, then things will open up for those born in countries not directly affected by the retorgression.

I'm from Belarus.Does it means i'll not be affected by retrogression and things'll be quicker?
