My BON notified my employer of my open formal complaint

Nurses Recovery

Anyone else have this happen? I have an open formal complaint, my license remains active. I have had an interview with the investigator with my lawyer on the call(nothing in person b/c of covid). Next step is responding to allegations. My manager called me in their office and informed me that they received notice of my open complaint. There’s been no action. My lawyer told me I didn’t have to say anything to my employer unless Action was taken and it hasn’t yet.
I felt completely shell-shocked and basically said my previous employer said I had co-waste discrepancies and I have hired a lawyer to defend myself. I said that per my lawyer this issue may be resolved without action on my license so I’m not trying to be deceitful.
I asked if there was anything I needed to do for my current employer, she said no. Just to continue to work and make sure you’re documenting and charting correctly.
I knew that I mostly likely would have to address this at some point, but I was hoping it was months from now when the BON made a decision about my actions.

One harsh reality about nursing is that nothing is kept within the bounds it should. We as nurses see things one way, and all those above us see it another way. Our employers, the State BONs, etc are not out to do what’s best for us as healthcare providers. They are there to protect the public and patients. Is it right? No, not always. Is it our reality? Yep.

One of my managers or nursing instructors told us to "chart like the Board has you in the room and they're projecting your charting onto a big screen" (meaning that if you ever went in front of the board, your charting would have to be so clear that either you could remember what you'd done or it was all right there for you). I still overchart. Even when given the option of a click box.....I'm not saying that's right, just saying that's me.

My girlfriend and I reside in Florida.  She's an RN and had an administrative complaint filed against her, and she needs to have a evaluation done by an IPN approved doctor...recommend anyone that doesn't charge some ungodly amount?  Besides money I hear most of these evaluators do a dog and pony show, then side against the nurse anyway in most cases.

I’m in MI our Monitoring program charges $850 for an eval. I reached out to a few private addiction doctors and they want between $600-$800. It’s better to go with a private practice doctor vs the States evaluator b/c they will definitely twist your words and use it against you to sign a contract. The goal is to deny deny deny. If you have a negative drug test I’d never admit to having a problem. I wouldn’t even say I have a glass of wine after a hard shift b/c it implies a unhealthy coping mechanism. Also, with mental health I would be careful to say that working during this pandemic has caused extra stress. They basically want to get to say anything that could be used against you. Best of luck.

There is usually a list of approved physicians on your state's BON website. You can also call individual psychiatrists/Physicians who specialize in addiction medicine and see if they meet the qualifications of your state BON. The cost is what it is and I've never seen these cost less than $300.00 or more than $1500.00. For what it's worth I was able to write off all my associated medical costs including RDS on my taxes for the five years I was in program so I would advise checking with a tak attorney.
