According to a report by the Joint Economic Committee of the U.S. Congress, comprehensive reforms in medical malpractice laws could improve access to health care, particularly for women, low-income individuals, and rural residents, as well as increase the number of Americans with health insurance by as many as 3.9 million people.

I agree. Please call your Senator and ask him to vote against legislation which curbs innocent victim's ability to be compensated for injuries committed against them.
The crisis has been caused mostly by our insurance industry. Our insurance industry is behind all of this. They are increasingly making profits (billions)every year and wrongly placing blame on the judicial system and legal profession to line their own pockets.
Unfortunately, the medical field has come to believe that only the legal system is at fault. Don't believe the propaganda!!!!

I wholeheartedly agree! 98,000 people die each year from medical mistakes. Low, negligent, staffing is responsible for a good part of it. Isn't that what is being said constantly on this listserve? Everyone complains about the disgraceful staffing, and working conditions where they work. Do you think that you work in these hospitals in a vacuum? The mistakes that are made by nurses due to these disgraceful conditions are completely avoidable. Shouldn't patients and/or their families be compensated when, what amounts to corporate neglegence and a "bottom line mentality", is responsible for their deaths, and injuries? I certainly think so.
Hospitals and insurance companies are trying to cut their financial losses by attempting to eliminate any and all responsiblity, and their consequences, of their "bean counter" mentality, by pushing for "Tort Reform", and "Medical Malpractice" reform. Think about it. If hospitals and insurance companies, were more frequently held accountable for the neglegent staffing situations that occur, and were sued consistently for the results of their neglent staffing patterns, it would eventually occur to them that it is REALLY IN THEIR BEST INTERESTS, AND THE BEST INTERESTS OF THEIR BOTTOM LINE, to staff adequatly. Why do nurses "enable" hospitals to understaff, by supporting "tort reform". You are biting your nose to spite your face. JMHO.

huh? Far from it! Well ok I can see they could agree on that but it's people too especially if you've been injured.
I'm in pa and there's this ok I was going to say something nasty but this senator Rick Santorum and he's all talk and I have no idea WHY people voted for him. He kept pushing for caps on medical malpractice law suits kept pushing then his wife sued for malpractice due to some injury in the health field and it was a DIFFERENT story with his loved one. She was suing for over $500,000 I thought. Insane. The senator I mean.
Yes, I too was surprised to see how the information could be twisted to serve the interests of the legal beagles.

First, define "frivolous lawsuit." In your own words. Second, a lot of information in the "every pt count" interestingly leaves out A LOT. Anyone with good reasoning and analytical skills could ask a TON of questions that would probably shoot a million holes in such weak arguments.

"Mega-judgement"; "never get one with a frivolous lawsuit". Making mickey d's pay $2.7 million because some idiot spilled hot coffee in their lap while driving a car. There's a reason for calling it "hot". There's a reason you aren't supposed to drive while eating, drinking, smoking, talking on your cell phone or having sex! Yeah, we've all done some or all of that, but your putting yourself at risk and other drivers. You are right--making some dumbass a millionaire because they can't take responsibility for their actions is not frivolous...it's ludicrous! Perhaps you should unwrap yourself from that tree you are hugging before you go accusing others for not being able to think or do research. The sad thing is... by the time your lawyer friends took their cut she MIGHT have had enough left over to pay her bills.
