I have a question for anyone familiar with criminal charges and attempting to apply to a nursing program. I was informed today, by an attorney that in order to expunge a charge from 2011 off my criminal record that I have to wait until April 2018. With that being said, I will be graduating with my Associates in Science in December. Initially, I had planned to apply to the nursing program in the fall of 2017. But now that I know it would be best to wait another year, I hate that I feel like I will be wasting unnecessary time just to expunge my record that may possibly be seen either way. I do not like the idea of waiting longer than I had initially planned, but if it means I will not have to tell the Nursing Board of my past than so be it. But regardless, should I just explain everything to my nursing adviser and attempt applying before it is expunged? (2 years to expunge-2 years to complete the program) I hope someone will have some insight on this situation.

Wait until you get it expunged and save yourself from the hassle of dealing with your state's BON.

I think I would decide whether or not to discuss it based on what the actual charge was.

I'm not sure what state you live in, or where the above commenters are from but I can tell you that Florida BON asks if you've had anything sealed or expunged on their application.. So you would have to disclose it either way. Our professors advised us to disclose absolutely EVERYTHING so as to not run into any problems in the future and be accused of non-disclosure. In my opinion, I wouldn't put off nursing school for another year because of the situation you described.

I do understand that different states do things differently, and some require you to run the background check with the BON before starting the program, but it depends on where you live. Like I said, Florida doesn't do that until after you've completed the program and are applying to take the NCLEX. It would be helpful if we knew what state you are planning to apply to.

Thank you so much! I'm sorry I did not post the state. I am applying in the state of Kentucky. I called and spoke to someone at the BON in Louisville and she reassured me that I am not the only person to have this situation. Are you familiar with this states policies?

If a record is expunged and a background check wouldn't acknowledge it, why disclose it? Best route is to consult with a lawyer familiar with these checks on whether or not an expunged record with surface and then make a decision.

Disclosing when the other party could not access it anyways = bad
