Foreign Graduate, Taking NCLEX

Hello everyone! I graduated nursing 2009 in the Philippines then went immediately to US without taking my NLE, I'm from Virginia but I'm taking my NCLEX from Maryland since they don't need me to be licensed. I took NCLEX 3X but all failed :( now they sent me a letter that I'm no longer eligible to take NCLEX if I'm from another compact state (Virginia). Now I don't know what to do, do I need to start all over again of new requirements (CGFNS, TOEFL, IELTS). By the Way, I'm already a US citizen, do I need the same requirements to acquire NCLEX? Please Help!

Maryland BoN started enforcing the NLC rules October 2012, hence why you were previously permitted to sit for the NCLEX.

Effective October 1, 2012, any Registered Nurse (RN) or Licensed Practical Nurse (LPN) applying for licensure and living in a member state of the Multistate Licensure Compact must take the NCLEX exam in their home state. The Maryland Board of Nursing is required by the Nurse Practice Act (Health Occupations, Title 8, Annotated Code of Maryland), to abide by the below regulations:

  • 8-301(d) - A Registered Nurse (RN) or Licensed Practical Nurse (LPN) can hold a license in only one party state at a time and that license has to be issued from the home state of the licensee;
  • 8-304(2)(iv)- An applicant for licensure by examination in Maryland must submit satisfactory evidence to the Board that the applicant's primary state of residence is Maryland or a state that is not a party to the compact; and
  • 8-305(b) An applicant whose primary state of residence is a party state, other than Maryland, is not entitled to be examined for a license as an RN or LPN in Maryland.

Please understand that if the Board receives your application and you live in a Compact State, your application WILL NOT be processed and WILL BE returned to you.

All compact states are now obligated to follow the NLC rules regarding state of permanent residence.

Since NM is a compact state also you are not eligible to apply for a license there if you are a permanent resident of VA. From the application from NM BoN

Do not submit your application if you list a compact state as your primary residence.

You must apply to take the examination in your primary state of residence if it is a compact state.

Compact states are Arizona, Arkansas, Colorado, Delaware, Idaho, Iowa, Kentucky, Maine, Maryland, Mississippi, Missouri, Nebraska, New Hampshire, North Carolina, North Dakota, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia and Wisconsin

Applications will be returned unprocessed if your state of residence is one of these states

Citizenship is not as relevant as where your permanent residence. Your only option, other than applying in VA is to apply to a non-compact state but if you want to practice nursing in VA you must meet the requirements of VA BoN for IENs.

u can try other state like florida, new york new mexico. your residence status doesnt affect or no bearing with the regulation of the state brn.

Residency in terms of visa/GC status doesn't matter, but residency in terms of where you live does. If you live in a "compact state" (which MD is), you cannot apply for licensure in another compact state (which NM is). NM is not an option for the OP (although FL and NY are).

thanks for the reply, but why would the Maryland BON allowed me to take the Nclex for many times, then just told me that i cannot take it anymore? if im a US citizen, will it be a different requirements to take NCLEX?

hi there! whats the requirements in New Mexico? are you licensed in the philippines? coz' i don't have anything, i just keep studying and taking review classes until i pass the NCLEX! now that i'm ready to retake the exam, but this situatuion came up, and i don't want to start all over again, you know what i mean (taking CGFNS, TOEFL, paying fees)! :(

u can try other state like florida, new york new mexico. your residence status doesnt affect or no bearing with the regulation of the state brn. the regulation applies similarly with the immigrant. try to consider reviewing Saunders Hurst Kaplan pda for the content. good luck kabayan

thank you kabayan! i'll try to contact CGFNS, coz' it's been 4yrs since i filed my CES for maryland BON, i think i have to re-process it, hopefully i will not take another English test, but dunno, i have to ask them.... what i need to do is to look for another state for my application, i'll go look on what you suggested... i'll keep you all posted!

Have you tried the state BON website or even email the BON and ask them?
