False positive

How common is a false positive proved with blood tests they say I tested positive they won't tell me for what I requested a retest they said they'll use the other half of the sample they already took which doesn't make sense to me

 

It's not OK in the eyes of the monitoring program/BON/Prosecutor because the Chain of Custody is different regarding WHERE the RESULTS go.  In your normal everyday testing, when you are selected and go to the Test Center, the results go straight into your Affinity or Spectrum or Recovery Trek Account (whatever state you are in) and to your Case Manager who is the first to see them.  When you go to the exact same testing location on your own which means......you ordered the test yourself, you weren't selected, but you ordered it, or got it ordered online, the results don't go back into your Spectrum, Affinity or Recovery Trek Account and directly to your Case Manager.  This is where the Prosecutor will fight it and this is why the BON's and monitoring programs say, "we don't approve tests on your own, etc" because the results don't go directly back to them when you order your own test or when you get it ordered online.  The results come to you or whatever your email is or however you set it up when ordered online.

STILL!  A judge will absolutely take it into consideration if it reaches the level of a judge and it presents a major clog for the people trying to bury you.  Even IF the prosecutor gets the evidence thrown out, the cat is out of the bag and your attorney, the prosecutor, and the judge already know the Negative Results and that is burning in the back of their brains related to future decisions being made about you.  Many (most of the time) the test will be allowed as evidence.  It's definitely a RISK a nurse absolutely wants to take and pay the 2 or 3 or 4 hundred or whatever it is out of pocket for that hair test.....In the Event that the nurse knows deep down, they did nothing wrong.  In the event that the nurse deep down knows they slipped or made a mistake, a test done on your own is a waste of time and money.

We don't order any test. We go to the test site to test and rell them to send the results to the monitoring agency if we are mandated to test or if we opt to test.  The chain of custody is the same

despite the prosecutors objection, the judge DID state that speaks volumes to my credit and innocence.  So it was beneficial for me....

Judges and courts are far more fair and just than the monitoring programs.

And nobody ever stated at any time that "we order tests" in our monitoring program. Of course we go to test if selected. What I wrote was, we can order our own test on our own."  I do it every 3 months. There's 10 different websites where people can order their own hair tested and the requisition gets signed by a Doc and we take the form to the testing site. When I show up eith that form that test and results is not related to my monitoring program. It's on my own. I have done this for years. O get my own hair test pay for it out of pocket, takes 30 seconds online to order it and I have proof of ongoing sobriety for myself and guess what else, my results also go directly to my lawyer which I ensure is on the requirements form. This means if they try the false positive BS or try the UTI ***, I am covered. It's expensive, but it's peace of mind.

Exactly and I've told this and have been told this by smart folks for years. Order your own test to cover you. Nurses believe what they are told and too often will not think outside of the box. When they are told, "your test or eval is not good unless we approve it" by the BON so the nurse believes it and doesn't retest and they get buried. 

I recommend this for all nurse in monitoring because my lawyer is a former nurse and she's sharp. She told me from day one, go online and find one of the many websites where a person can order their own test. You can do many things. Cholesterol etc. She said do an all inclusive hair panel every 3 months for drugs and I simply click what I want, a physician signs it online, and the lab requisition form I then print, and take it to the lab. I have the results printed on the requirements form that go straight from the lab to my attorney and also to me. This way, they can't argue chain of custody. Expensive? Yep 400 bucks but peace of mind? Absolutely.

In monitoring we don't order tests. Your situation is different. A hair test every 3 months doesn't cover alcohol FYI A uds wouldn't go back far enough to count for the powers that be. If you wanted to really be safe a uds a week. And an observed uds

Once again nobody ever wrote on this board that the nurse orders their own test in monitoring.

3rd time..(just for you)...  Alcohol can be ordered in a hair test and I do it q 3 months like my lawyer said and she also said if I ever have a positive Alcohol urine test get a Peth immediately.  A nurse can order any test they choose and so you can JoeBob from the street or any human through online lab test self ordering websites that we pay for out of pocket, the results go to our lawyers. I can go online and order my own STD test, cholesterol, drug test LFTs and so can any other human.

The nurse in this post that did exactly that is the example and it saved her. Nobody's situation is different. Any human can order their own test and give it to a lawyer and the judge decides (if it reaches that level( whether it's admissible. 

Always order your own test my many of the online websites and get your own hair test including Alcohol every 3 months and give it to your lawyer.

All of the above is in addition to your normal routine monitoring program that selects you and orders your test.

Hair tests aren't reliable for alcohol and you absolutely can drink and have a negative peth test. This wouldn't be acceptable for my monitoring program. They like "random " tests among other things.

Like I wrote always ensure you get your own test on the side whenever in doubt to cover yourself as evidenced by the nurse who had success with this in is thread. It's important to do because it's not about what the monitoring program "likes or accepts," or what is "acceptable" to the monitoring program. It's about what is acceptable to the Judge and if a case reaches an admin law Judge, that Judge has the power, not the BON or Monitoring Program and it's what the Judge accepts.

Well it was still positive theyre saying the alcohol was 29 when the cutoff is 20 the problem is I've not had any alcohol since this program started

I will repeat....Hair Test and Nail Test. Never let time go by and fall into the "waiting game" and "back and forth" with the monitoring program and "waiting to hear back from them." For any nurse that finds themselves in this situation.....as soon as you are told by the monitoring people that you had a positive and you know for sure you did nothing wrong, IMMEDIATELY get a hair and nail test on your own. Don't wait a week to "hear back" or that they are "rechecking and confirming it" GO TEST. They love to delay and take their timr. Order your own test online from one of the many self ordering lab test websites and test. Take those results to a lawyer. Don't worry about whether a hair test is "weak for alcohol" or be discouraged about how your test will "not be valid." Get a Test. Take to lawyer. Continue to inform monitoring you have not drank alcohol. Will a negative hair and nail test work 100 percent of the time and get you out of it? Of course not, but sometimes it can and it for sure, can Not hurt and it's the only chance you got.
