Diversion for Criminal Charges

Just curious...how many people here have been charged with a felony for diverting at work and recieved diversion for these charges. My public defender is trying to get this by showing im in an extensive rehab program aka monitoring. I just wandered how likely it is or if anyone else has gotten this. I know it doesnt mean i will but I am curious.

All pretrial intervention programs/diversion programs in the USA requires Healthcare workers to go to rehab as part of that program IF thr Healthcare worker has diverted,  but your so ignorant you don't even know what a pretrial diversion/intervention program is.

Go spend your time telling everyone how you don't belong here, and that you don't have and SUD and that all BONs are bad, and how everyone should get out of Nursing or not do a monitoring program yet.....your *** remains in a monitoring program and in nursing, LOL. That's your mantra and all you offer to this board.

You're quite rude.  Im going to tske tge high road. Someone at a Cadeucus meeting diverted drugs and did no rehab and no jail or prison. 

Let her get advice from an attorney.

And you are quite dumb because you comment on things you have no clue on and that is simply not smart. What is also not smart? Taking one person's story at a Caduceus meeting as gospel and full proof when you haven't traveled the country workingnin recovery programs like I have trying to get nurses help and out of trouble and seeing the criminal process play out time and time again.

I have no problem with your usual spill for nurses who do NOT have an SUD like yourself and you do the usual with them about how the BON is evil, how you shouldn't be in monitoring, and you being OK with nurses drinking alcohol if they can beat the system. That's fine and I let it go for those who don't have SUDa, bit when you pull your narcissistic ignorance on a nurse whonhas an SUD an felony charges, you've gone to far and your advice is a tuslly Harming her. You are HURTiNG people by trying to simply argue and chime in (because narcissists do that). The girl needs rehab. Anyone who diverts needs rehab but aside from thstaide from they, the criminal side automatically mandates it

Swe what dumb dumb wrote? Dumb dumb wrote that you basically don't need rehab. That's essentially what dumb dumb is saying because dumb dumb thinks nobody needs rehab even in the face of diversion and criminal charges. See the level of dumb? Pure and plain. Dumb dumb but in reality, it's narcissism. Narci's love to comment on things they have no clue about because they can't help themselves which is why Narci is currently being monitored in a program. That's the core problem of how she ended up here.

You are not a lawyer and should stop acting like one. You aren't a physician and should stop acting like one.  You are acting like an expert which you are not. I give suggestions you post like you are an authority which you are not. You should watch yourself.   I'm going to skip your posts from now on..

Be quite. Never said I was a lawyer. Never said physician either and not acting like one. It appears that way to you because you are dumber than a rock. You should watch yourself dumb dumb because telling addicts they don't need rehab is.....dumb and dumb dumba do dumb things

I diverted for years and fortunately never got caught, but my addiction sure did catch up with me in every other aspect of my life.  I would say it is most definitely in your best interest to get yourself into treatment as soon as possible. One of my good friends I met in treatment was facing felony charges for diverting from the VA and she just found out her charges ended up getting dropped. Her lawyer said it was because of the fact that she went to a reputable treatment center for healthcare professionals and enrolled in her state's monitoring program and has been compliant ever since. I was in denial for a long time that I had an issue, even though I was diverting and using IV opioids.  Pure insanity.  You will find you are not alone.  I left treatment a lot happier than when I went in. Don't get me wrong, monitoring absolutely sucks and I can't wait to be done, but it will end and you will get through all of this!!

your friends charges got dropped? oh thats amazing. what treatment did she get into? and what else did she do? if you have any info please let me know... I am terrified and my process hasn't even started....

I'm sorry, I can't imagine what you're going through.  She says to obviously lawyer up, and retain someone who specializes in this kind of thing. And to take the initiative to go to treatment, but make sure it is a facility that is approved by your states monitoring program so that you don't have to repeat it. The Florida Recovery Center specializes in healthcare professionals and is an approved treatment center. She said her lawyer dealt with everything and her charges got dropped about a year after she got out of treatment because she has been compliant with everything. 

How long does it take to see criminal charges if they will come after you? It's been 4 months since I was caught. I have a lawyer who told me I won't go to jail, finished IOP, go to weekly smart recovery meetings, level one meetings, and test negative for every UA. This post has me freaked out now that they'll still come after me. My rehab facility just sent recommendations that I can return to work and doing very well in recovery

To add to this, I admitted to the BON to diverting 3 vials of fentanyl 😞

I got caught and fired Sept 2018. Immediately entered my states program for nurses. I'm in Indiana. I heard from a investigator regarding possible charges at the end of October 2018 and got charges filed December 2018. I would think that you would have already heard something if they were going to file charges. My place of employment turned me into the attorney generals office who did the investigation. Fingers crossed no charges for you!! It's much easier without the criminal aspect to deal with. Hard enough as it is. I graduated the program in 2021 and had my license taken off probation last year. Thank GOD!! It's hard but we get through it if we stay clean. (Charged with 14 felonies and took a plea deal for 2 misdemeanors and probation for 1 year, no jail time) Don't be scared, everyone's case is different. I never had to stop working, I got really lucky. They didn't even make me go to rehab just meetings and the program and probation.
