I would NOT waste money on an attorney...you broke the rules, your reason doesn't matter. I would wait and see what the BRN decides and if you get a chance to retest, leave the phone at home and wear a watch.
Don't people wear watches anymore? How do you function in healthcare without a watch?
you can't wear a watch..you get padded down and have your pockets emptied out inside and out and for also, they didn't enforce to read the rules either.
Even if you can't wear a watch for the test, the rules are the rules. If they said "no electronic devices," why did you use yours? If you can't follow the basic rules to take the test, how are you going to function in a facility that has tons of rules and regs." "Yes, but my case is different"?
You can't wear a watch. You get patted down. You have to empty your pockets. But somehow your cell phone made it in the testing room? You broke the rules. Blatantly broke the rules. You just ruined your chances for a future in nursing. Accept your consequences and do not expect a whole lot of sympathy.
Over the past 18 months I have taken MANY exams at Pearson testing center. They are VERY thorough. They even check for visible tattoos (yes someone actually had answers permanently inked onto their body) and have lockers for personal items. They tell you immediately before entering into the testing room that no electronic devices can be accessed and have you place them in a small basket in the back of the locker. They do this not to punish those that do not cheat but to weed out the ones that do. I as a nurse do not want to work on a unit with someone that passed the board exam by cheating and certainly do NOT want my children, husband, father or any family member taken care of by someone that was not competent to pass an exam without cheating. This said, please take responsibility for your actions, when you talk with the CA BRN explain that yes, you did have a lapse in judgment and it will not be repeated. I am sure this will go MUCH farther with them than saying their rules dont make sense and should not apply to everyone. You really do get more files with hunny than you do vinegar. And I also agree with the posts that have stated rules will follow you everywhere in nursing. YOu can not tell an MD that you did not agree with his orders so just made a little adjustment because it suited you better. Good Luck but if this or any of the posts here offended you, go into buisness for yourself where you do get to make the rules.
