Hi!
I have 2 friends (married to each other) who both applied to the California BON just last month to sit for the NCLEX exam.
The problem now is that they are having marital troubles and will probably result in an annulment of their marriage.
I'm wondering what the procedures are for such situations and if there will be some adverse effects on their applications.
They also assert that they still want to go to the US together though despite their current troubles. Is it possible for them to go together and work in the same hospital/facility or at least the same city if their marriage is annulled?
Thanks

in my opinion, it is possible for them to work in the same hospital. for marriage couples, most of the hospitals employ them actually bearing in mind, that they work in different departments or units. They can't be together in one unit...
and the nclex thing, they just have to present 2 legal documents such as passport and a legal ID to support their names registered on the CA BON. so if they change one thing, be aware that they must have a valid document to support it.hope it helps!

Thanks! You have been a great help.
Just a clarification though: If their marriage is already annulled, can they even go to the US at the same time and work together? Suppose one of them is called to work first due to an employer having only selected that person, the second has to stay behind until called in right (probably by another hospital/facility or in another city)?

if they are doing it as 2 seperate applications with the hospital they shouldn't have any problems. If doing it together then it is up tp the hospital whether they will petition them both or whether they only have the job for 1. If the hospital agrees to petition them both as seperate then there should be no problems
Sounds great!
Thanks to you both for the help :)
I'm sure they will be pleased to hear the news.
Ok just talked to my friends who are in a marriage crisis. And well... this is gonna sound weird and stupid.
They said they are planning to pursue an annulment but they are going to start all over again immediately afterwards because they love each other. So there is a strong possibility that they will remarry again soon.
If they remarry before filing I140 applications, their status will count as married right? Will records indicating married -> single -> married in the span of a year or two be held against them?

Marriage has no issue in the I-140 at all, and only comes into play if the dependent is to be on the DS-230 and included with their visa as their dependent. With a marriage that is annulled, then there is no spouse to be included on the one petition.
They just need to make sure that they each have their own petition.

As a friend who's known both for a many years now, their relationship is getting to me and driving me bonkers because I'm totally sure that they are meant for each other and totally love each other. Their marriage is only going through the loops because the wife is under major depression is suddenly demanded annulment. LOL
Marriage has nothing to do with testing for the NCLEX exam, or even licensure. It only comes into play if they are wanting to bring a spouse as a dependent. But CA BRN could care less what their marriage status is. In the US it is not even mentioned most of the time, it does not influence anything.

I think not especially if they are still in the process of applying for an immigrant visa since annulment in the Phlippine law means "no marriage occurred".
They'd have to go on processing on their own in case their marriage is annulled.

I cannot understand why these couples would want to annul their marriage and then "start over" again when they can just work things out right now so as to avoid the hassles of such a situation?
I was wondering about this myself. They could save themselves the difficulties of going through an annulment (not to mention the costs and time).
Things are becoming clearer now though. They both consulted a psychiatrist and the shrink found out that the wife had an onset of a sociopathic personality in the course of their relationship apparently due to a traumatic childhood (abandoned, battered and abused child).
This would mean that they can no longer be together now though unless the husband is willing to go through a world of pain and sacrifices. The shrink advised the husband to look for another woman now because he'll only be betrayed and hurt a lot if he decides to continue the relationship.
Sad, sad story. They used to be the image of the perfect couple until the recent unfortunate chain of events.
If a person is diagnosed as having an anti-social personality disorder or sociopathic personality, would she be denied entry to work in the USA as a nurse?
