Can I-140 be filed before NCLEX to save time

Hello All,

I hear conflicting opinions in whether the I-140 be filed before doing the NCLEX license, etc.

Is it possible to file I-140 while I am working on my NCLEX? This way by the time they call me, I would have the NCLEX, visa screen, and hopefully a job!

Also, is it MUCH better to get a job where the employer does the immigration Vs me doing it myself?

My friend lives in Texas and that is where I will be living, he can file the I-140 + fees etc if this can be done.

PLEASE HELP! We are new to this and have already made mistakes with CGFNS that has cost us lots of wasted time. After doing this entire process, I can perhaps start a nursing agency! (ha ha).

Hello Dolly, In my opinion you need to first pass the NCLEX. Based on this normally the employer would hire you by means of filing I-140/I-485 concurrently. While these get processed, you should have parallely started completing the Visa Screen certificate rqmnts so that this is available in time for your I-485 final adjudication.

It is hard to find an employer who would do the immigration. Besides, she will be in US on VWP (visa waiver program) in which one is not allowed to change visa status. I thought that even if we file an incomplete I-140, uscis can give us a filing date, so that by the time our turn comes, the NCLEX etc will be ready.

If you at least passed the CGFNS exam it is possible.

You must pass the CGFNS exam or the NCLEX exam to be able to even get a petition submitted. No way around that, you need to have documented proof of one of those exams to be included. And you need to have an employer sponsor you, it cannot be done by just a friend, especially with the RN green card.

I am an individual in Texas and I have a severly handicap + mentally retarded child. Can I file a I-140 for a foreign nurse who has done all cgfns (CES+VISA/SCREEN) and NCLEX and speaks a language that the whole family can communicate with her, (which We could not find locally -advertized on craigslist for 1 month) ? I saw that I-140 can be filed by individual, but does anyone has experience with this? Please help!
