Can a family file I-140 to hire foreign nurse

I am an individual in Texas and I have a severly handicap + mentally retarded child. Can I file a I-140 for a foreign nurse who has done all cgfns (CES+VISA/SCREEN) and NCLEX and speaks a language that the whole family can communicate with her, (which We could not find locally -advertized on craigslist for 1 month) ? I saw that I-140 can be filed by individual, but does anyone has experience with this? Please help!

I posed this question to an attorney, and this is his response: Any comments anyone? Sounds good and encouraging to me. I think I will proceed.

The problem that you may have is that it may be very expensive and may take a long time. That is why agencies or hospitals handle doing this in bulk.

Yeah, I was thinking that myself that if I mess it up than USCIS can make it very difficult in future. But, on the other hand, if I just fill the I-140 and submit it, then they could just ask for more information, or, reject it without any harm. Why do you think it can be very expensive? I can fill that form and mail it to uscis with the check and what ever else it requires. Lawyers charge $800 to fill the same form, I do not understand what do they do so different than what anyone can do?

Reminds me of those traffic ticket lawyers who charge you $100 for doing what you can do yourself by walking up to the window. Right?

it is quiet expensive and I am not sure if you have to file stuff like your income, expenses, proof that you have tried to get someone locally. Best either ask this in the thread questions for suzanne or send her a pm/email which you can do if you click on her name

The issue is that you need to show proof of paying the nurse the actual average of wages for that area. The same rate that they would get in a hospital or facility..............There is quite a bit of documentation that will needed, it is not as simple as just filing a form. You will need a Certficate from the Labor Board, showing that you tried to hire an American first, or someone that did not require sponsorship. There are multiple documents that need to be filed, and it s not an easy process to do. Especially if you are not a regular employer who has done this in the past.

Even if they live in your home, and you are paying for their full support, you will need to pay them the going rate for RNs in that area. Have you thought of that? And you will need to show proof that you have those funds available for a certain amount of time for the salary.

There is much more to it than completing just a few pages. And if you are having issued with the $800 for the attorney, this is not going to be the route for you to go.
