I handed in my letter of resignation 3wks ago. I have 1 more week to go. I noticed on my check on Friday that they didn't take out any money for my medical benefits. Unable to speak to anyone in HR due to the holiday. Is this legal? I was told that I would be covered until the end of Jan. Then I could get COBRA. I hope they don't think that I am going to pay for Cobra for the month of Jan. I have a medical appt on Jan 13th ,.so I still need these benefits. I just have this feeling that they are going to try and screw me. HR and my supv are shady. Can anyone please give any advice as what should I do? Thank You.
I am certainly not an insurance agent but at my last job, I was responsible for HR issues. We were specifically told by our insurance carriers (we offered several) that premiums are paid by month, no partial premiums are allowed which is why employees have their insurance premiums deducted for the next month in the paychecks for this month.
As a result, an employee who's last day is 1/8/09 has already paid premiums through 1/31 and therefore has coverage through that date. COBRA notices would be printed in Feb and then there might be a gap in terms of retroactive coverage in February.
This was always such a pain for me since basically anybody who quit apparently already knew this and always chose the first day of the month as their last since they knew they had coverage for the whole month that followed (and then you had to fix their payroll so no premiums were deducted for that one day in the new month). The company I worked for employed people in five different states and we had plans in each. Maybe it is a COBRA law thing, who knows?

I know this is an old thread but I recently changed jobs. I had two premiums this month drawn on Oct 3 and Oct 17 pay checks and my last day was Oct 17. They took out my premium on Oct 17 and told me my benefits would be cut off that day. I have never had this happen before as what you described I have always had benefits till the end of the month. In addition, I was not even told this. When I handed in my equipment on my last day it dawned on me I was not told anything about benefits. I emailed HR over the weekend and found this out after the fact. Is there anything I can do?

??? But this is the topic? I thought we were just discussing the issue. I was a health insurance agent for ~10 years, so insurance-related threads tend to catch my eye.
