I just want to ask if anyone among you know how long should you stay in the US as an immigrant worker until you are allowed to file a divorce without having your dependent spouse loose his own immigrant status?

at a guess I don't think it matters unless you have come over after either just marrying a US citizen or fiance visa. If you have come this route there are conditions applied if married less than 2 years which could affect the GC.
thanks for the input. My husband and I have been separated but not legally. I choose to delay the processing of annulment so I could still nclude him as my dependent. It's purely for my kid's future that I am really after. I know that when you get divorced in the US, both parents must give certain amount for the kid every month which is computed by the court till he reach 18 yo.I just wanna make sure that his status as an immigrant won't be affected. Besides, getting divorce in the US is way easier than in my country :)

We're in the same boat gabgab that's why I got interested in your thread.But in my case I did not include him in my petition anymore.I'm bad eh? LOL:D

this thread scares me a lot...i don't want to divorce my husband...he's quite a nice and caring husband...one of my fears is him leaving me when we get into the land where divorce is allowed....
but i'm quite a loving and caring wife too....he won't leave for another....
oh no....im very SORRY.....i did not mean to scare anybody with my post....my intention is just to caution nurses on the facts of life
