CA license with ITIN instead of SSN?

Published

Has anyone been able to get the CA license by using an ITIN number instead of the SSN?

I don't have an SSN (I'm on H4 visa). I gave CA board my ITIN, is that enough to get the actual license and get the NCLEX results displayed on the board license verification website?

LR

From the California BON Website

"SOCIAL SECURITY NUMBER

Disclosure of your social security number is mandatory

. Section 30 of the Business and Professions Code and Public Law 94-455 (42 USCA 405 ©(2)©) authorize collection of your social security number.Your social security number will be used exclusively for tax enforcement purposes, for purposes ofcompliance with any judgment or order for family support in accordance with Section 11350.6 of the

Welfare and Institutions Code, or for verification of licensure or examination status by a licensing orexamination entity which utilizes a national examination where licensure is reciprocal with the requesting

state. If you fail to list your social security number, your application for initial or renewal licensewill not be processed. You will also be reported to the Franchise Tax Board, which may assess a $100

penalty against you. Questions regarding the Franchise Tax Board should be directed to (800) 852-5711."

So no ITIN allowed sorry. If you are legally here to work what is the big deal about giving your SS number?

That is a state law. Federal Law over rides state laws

hi! i think this reply is kinda late already. but for everyone's info, you can get ur cali license just with an itin. but let them know it's ur itin (send them the paper irs sent you assigning you the number). your license will be valid for 2 birthdays and will expire the month after ur 2nd birthday.

but, without the ssn, you won't be able to renew your license.

good luck!

i was thinking most states would accept a itin instead of ssn.

i am not comfortable giving my ssn out to anyone, i mean anyone.

my social security number is between me and the social security office and when i get ready to get my social security benefits.

too much identity theft by giving out social security numbers....

I am not an attorney but what you posted is regarding applying for a position. The issue is the BON issuing a license.

One such federal law requiring collection of your SSN is the Personal Responsibility and Work

Opportunity Reconciliation Act of 1996, which says that your SSN must be collected on an

application for any professional license, driver’s license, occupational license, recreational

license, or marriage license. (42 U.S.C. 666(a)(13).)

The issue is that a SSN# is going to be needed by any state for licensure now, as well as given to any employer.

There is no way to get around not using it, but you need to be careful as to whom it is given to. Otherwise not a problem.

Americans do not get ITIN#s in the first place, they get the SSN# directly.

If a state requires it, and one wishes a license in that state, then you need to provide it. Or the final outcome, you will not work.

And for using the ITIN# for CA; if you are not going to have a visa and then the SSN# within the three years, all is going to be lost if you are unable to renew the license as well. And if they wanted the ITIN#, they would have posted that on their website as well as included it in the application, but there is only a spot for the SSN#.
