BRN LETTER OF ACCUSATION.

A few years back I was working for a horrible hospice agency and I knew shortly after my 2nd month I wasn't staying.  I had serious issues with harassement from my then acting supervisor.  I was micromanaged to the point I was stressed going to work, receiving 30-50 text messages a shift.  I couldn't do anything without my manager on the phone.  I had given her no reason to this. I complained to our director, nothing happened.   As I was going to into work on time on my last day the manager texted me asking where am I?  I messaged I am outside my appt where I am suppose to be.  I lost my mind with this constant inquiry and doubt of me.  I texted back I quit. I am bringing my things into the office.  I am done here.  

SHort of the long they filed a complain to the BRN against my license.  There was a laundry list of complaints. I hired an atty, had an interview and waited a year and a half later to get a certified document- they are pursuing the accusation of incompetence and unprofessional conduct.  The claim was I was directed to do an admission on a patient the day before, That was not entirely true.  Admissions happen in the place of service,n not at the hospital where this patient was……. However, it doesn't matter as out of the laundry list of complaints that one is it.  

I retained the same atty I had before.  California is an at will state, but that doesn't seem to apply here. My Director was upset because she had to go out and finishe what she claimed was my assignment.  Also, resigning before I started work was a factor in this.... Nobody died, nobody was hurt.  But here I am going into battle for my license after 30 years of being an RN, mostly hospice....

I hope you have a record of the texts.  They would have a difficult time deciding that you were at more fault than she because of her constant harassment .  She's behaving erratically.

At will works both ways so I don't know how the company can penalize you for this. You quit before starting work, you didn't abandon a patient. This sounds crazy. I hope you are able to successfully defend yourself AND make this hospice pay your legal fees.

In my experience as a volunteer for a state BON, people lose licensure for serious stuff that can or does lead to patient harm: practicing impaired by drugs or alcohol, theft, exceeding scope of licensure that results in serious harm, abuse of a vulnerable patient, drug diversion or other felonious behavior, for example. They get a lot of complaints from family, physicians, patients, and employers like yours.

Annoying the staffing coordinator, being rude, being slovenly, being late to work, lousy documentation, HIPAA problems can all get you fired, but it's unlikely that the BON will do anything but toss those in the circular file.

You don't mention whether your orientation was satisfactory or whether you got any kind of written counseling about your performance; if not, while you might have gotten fired, it's unlikely that your license would be at risk. I'm not an atty and can't give legal advice, that's why you have one. If you've had 30 yrs hospice experience, then you might even be able to get a settlement based on age discrimination. But absent anything else I don't see here, it doesn't sound like you'll lose your license over this.

I can't understand. Did they only report you recently to the BRN after a few years of quitting in that hospice?

Hi there,  specifically I quit this job 2/2/23.  I got a letter from the BRN in June of 2023.  I hired my atty that same month.  In December of 2023 I have a formal interview of an investigator on behalf of the BRN.  1 Year and 3 months later I got a court document indication they are pursuing my accusation.  I hope this break down helps.

Sorry you're going through this. I wouldn't wish it on anyone. I survived the CA BRN after months of emotional turmoil. Was on probation for gross negligence and incompetence. So I understand all the feelings you have right now. Feel free to DM me if you'd like to connect.
