update 1:

on june 6 dos ammended their june visabulletin by adding a new category for nurses (schedule - a) and making it as 'current'. that means, all wait is over for nurses now and gates are re-opened officially on june 6th.

as the regular readers of allnurses.com know, this thread can be connsidered as the continuation of the thread "worst news for rns from india, phili..." (click here to view that thread : https://allnurses.com/forums/showthread.php?t=87149). worst news thread was started when darkness and gloom hit intl. nurse community when dos announced (dec 11 2004) the retrogression for nurse immigration from these 3 countries.

appropriations bill in to a law :biggringiand henceforth , at

this very moment (may 11 2005 8:30 pm cst), additional 50,000 visas are available:melody:

for nurses:nurse: and their families.

RETROGRESSION WILL NOT END...

The one that was posted at Shusterman is a temporary relief for persons under Schedule A...if you are not on Shedule A you will still be afftected by retrogression if you were born in one of the PIC countries. Although as they estimate the numbers it would last for three years.

Schedule A Occupations

Schedule A is a list of occupations, set forth at 20 CFR 656.15, for which the Department has determined there are not sufficient U.S. workers who are able, willing, qualified and available. In addition, Schedule A establishes that the employment of aliens in such occupations will not adversely affect the wages and working conditions of U.S. workers similarly employed.

The occupations listed under Schedule A include:

Physical Therapists - who possess all the qualifications necessary to take the physical therapist licensing examination in the state in which they propose to practice physical therapy; and

Professional Nurses - the alien (i) has a Commission on Graduates in Foreign Nursing Schools (CGFNS) Certificate, (ii) the alien has passed the National Council Licensure Examination for Registered Nurses (NCLEX—RN) exam, or (iii) the alien holds a full and unrestricted (permanent) license to practice nursing in the state of intended employment.

Sciences or arts (except performing arts) - Aliens (except for aliens in the performing arts) of exceptional ability in the sciences or arts including college and university teachers of exceptional ability who have been practicing their science or art during the year prior to application and who intend to practice the same science or art in the United States. For purposes of this group, the term "science or art" means any field of knowledge and/or skill with respect to which colleges and universities commonly offer specialized courses leading to a degree in the knowledge and/or skill. An alien, however, need not have studied at a college or university in order to qualify for the Group II occupation.

Performing arts - Aliens of exceptional ability in the performing arts whose work during the past 12 months did require, and whose intended work in the United States will require, exceptional ability.

An employer shall apply for a labor certification for a Schedule A occupation by filing an ETA Form 9089, in duplicate with the appropriate USCIS Center, NOT with the Department of Labor or a SWA.

will just wait for the June 1, 2005 additional info for the visa bulletin. I agree that retrogression will not end, but the nurses and PT whose PD is 2002-2004 will benefit from the additional 50,000 additional visas

As i told my case is in consulate, that I am allmost close to packet 3. But I have not written my NCLEX/ Coz my hospital doesn't required us to write the exam from India. I need to join them and write the exam in US.

And I have cleared CGFNS TSE and TOEFL

But now I am little woried that with out passing NCLEX would i be considered under scedule A.

anybody know about this?????? Please let me now... I am lil worried

YOU ARE ON SCHEDULE A...SO DO NOT WORRY...YOU WILL HAVE THE SHARE OF THE 50,000 VISAS FOR NURSES AND PT'S...

Passing an NCLEX exam is not a requirement to be included on Schedule A. You must have a CGFNS certificate so that your employer/lawyer can file for your petition under Schedule A. In your words that you have passed all CGFNS and all english exams>>you should a have a visa screen certificate...That is the most important certificate that you must have because you have to present it to the consulate....

yes your employer/agency is RIGHT...you can take the NCLEX exam there in the U.S. when you get there. there's no problem about it...Having a CGFNS certificate is the most powerful tool for nurses because you can go to any state, although some states does not require to be CGFNS certified but there is no problem because the U.S. LAW has given the ICHP/CGFNS the power to certify foreign health care workers.

HI NIMISHA /SORRY WAS OUT FOR SONS PMT EXAMS/U NEED NOT WORRY AT ALL /EVEN IF U DONT PASS YOUR NCLEX ALL LIFE YOUR GREEN CARD ONCE ISSUED CANNOT BE WITHDRAWN/U HAVE TO HAVE A VISA SCREEN CERT FOR THAT ie FOR GETTING YOUR GREEN CARD/ YOU SHOULD HAVE NOTED I SAID CGFNS/NCLEX ie either of theses /AS DALE POINTED OUT VISA SCREEN IS VITAL //even if the retrogression is not lifted completely it will be lifted for PD s before 31 dec 2004 //most of the nurses will be covered in that and those after that will come in as the pd rolls forwards month by month//remember u are dealing with very intelectual people who can solve or create problems //IN OUR CASE THE NEED IS MUTUALLY SYMBIOTIC NOTHING TO WORRY //GOOD DAY GOD BLESS

Hello, glad to be a apart of this community. Iam from the Philippines and already have application on file. My priority date is July 2003... will this new development will hasten my application. My agency just paid my DS230 fee this month. I already have my visa screen certificate with me.

Another thing... I will be coming to the USA alone I will leave my daughter for a while here, what bothers me is that If times come that I will get here will there be visa to accomodate here..... will she be affected by the current retrogression. She's just turning three years old. My employer assured me that I can get her anytime I wish.......
