Depends. That is all anyone can say.

Regardless of what you were told, the BON will find your "expunged" record.

ok, but anyways even if they find your expunged records do you still have to confess it?

I am kinda in the same position, I think the answer is yes. You still have to tell them about it, BEFORE they find it. Even when your charge has been expunged, the BON will still see it. On your application, I think you need to still mark yes to being charged with a crime because you WERE charged with it, it is just 'hidden' for now. If you mark no and they do see it, they will consider that with-holding information and that does not look good for anyone. For me personally, I would rather mark yes, explain my situation, and hope that the fact that I got an expungement would show how much I've changed than mark no and risk looking like I was lying on my application. Your best bet though would be to contact the BON for your state. Good luck!

well i did check with my laywer and like other lawyer he told me I could check no since its been expunged and if the borad comes to me if "why u keep this info from up" or they say "why u check no when u have" could i not tell them cause it was expunged and my laywer said i could say no. what do you all think

If your BON asks if you've been arrested, charged and/or convicted and you answer, "no", you will be dishonest in answering. It does not matter if your record was expunged or not.

Only your BON can answer this. We cannot.

well i am talking about on the app, and anyways I have talked to my lawyer and teachers at my school in the nursing program and they say u dont have to because you dont now dont have a charge? idk i am getting two answers(here on the fourms its yes over t here to the prof its no)

i understand that you saying no will be dishonest, but being expunged is that i technically never committed a crime now...i dont know my lawyer keeps telling me that I can say no(i have called other lawyers too) but ppl here say I have to, so now everything that has to do with my nursing career do I have to say yes like if i was starting lets cause i am starting lpn private school later on in my life if i answer no i am being truthful cause like i said above getting it expunged destroys the whole thing

Which is why we tell members that we cannot answer regarding questions like this.

You need to make your own decision after your attorney advises you.

We will close this thread for we cannot help you any longer.

Good luck.
